And technically, Trump was NOT yet “a felon” until today. Imposing the sentence–even though it includes no penalties of any kind–made Trump a felon.
I share in the feelings of those outraged that Trump paid no penalty. However, Merchan’s choice is not really pro-Donald. His choice will make it very hard for any appellate court–or for Donald’s fans on SCOTUS–to overturn the conviction. Which they might have done on the basis of ‘you can’t impose onerous conditions on a President.’ Merchan imposed NO conditions, so that legal argument is undercut completely.
For an appeal to work now to turn Donald back into a non-felon, the court in question would have to find that the SCOTUS immunity ruling applied to Donald back in 2016 and early 2017 when he was not yet President. And it would take the stupidity/corruption of Aileen Cannon to make such an assertion.
It’s possible that neither appellate courts in New York State nor SCOTUS will be able to bring themselves to descend to the level of an Aileen Cannon.
