About the 'Late Earl Warren' meme

I just noticed that the phrase “the late Earl Warren” appears with some regularity on these boards. I checked out the Know Your Meme website and was unable to find anything on it. Can anyone explain the history of this?

Earl Warren is still dead.

It’s from the Simpsons - the “Itchy and Scratchy Movie” episode if I recall. Marge thinks that Bart could grow up to be a Supreme Court justice if he gets the right discipline, or will become a male stripper if he doesn’t. “Can’t he be both, like the late Earl Warren?” replies Homer.

Could it be that Warren might be confused for Earl Butz?
