Not to comment on the OP too specifically, but I gotta say something there. Men and women are different. Why would anyone think that the standards between the two should be identical? Not to say anyone should get preferential treatment or that this woman didn’t do something wrong, but in the general sense men and women conjur different impressions because we’re so fundmentally different. Its the way it is, to try and deny it is foolishness.

Spend the energy making sure the standards aren’t biased or predjudiced, but that doesn’t mean they are identical.

I. E., the “it must be consensual because I’m too hot to “molest” a teenager” defense.

You’ve got to draw the line someplace, and it seems to me it’s already been drawn- legally. Just because men and women are “different” doesn’t excuse the fact that there’s a double-standard inherent in your post.

I have mixed feelings for you, Carm6773. On the one hand, it’s pretty damned shitty to have to deal with collective accountability as an adult.

On the other hand, I remember spending a week in Sexual Harassment training because the whole country was upset about a little thing called Tailhook. I’m not saying that the situations are parallel - the Tailhook scandal did involve a hell of a lot of flyboys, not just one. However, we sure felt that we were getting the standard blue-shirt shaft for something that some effing Zeros (officers) did.

A lot of people believe, rightly or wrongly, that asshat behavior is going to be indicative of a larger group than those in the affected group usually see.

Back to the OP. Yeah, it sure sounds like the defense is “I’m too sexy for jail.” To which my reaction is tough tootie.

Absolutely. Subjective qualities have EVERYTHING to do with the law. In case of age-of-consent laws the court is trying to determine what harm if any resulted in the case ( or at least they should be, we are not about putting people in jail just for breaking the law, some harm must be involved). Therefore the defendants frame of mine has to be considered. Sure, we legally consider 14 year olds unable to consent to sexual conduct. However, if you consider a puppy love story with a teacher with a brutal sodomy or exploitative behavior.

If you tell me that it wouldn’t matter to the kid if she was 60-year old fat, ugly and toothless I’d call you a liar. Therefore it matters to the case, and matters to her punishment. Yes she still broke the law, yes she should be punished, and I’m not saying she should be punished less because she’s young. I’m saying she should be punished less because the magnitude of her crime ( which is violating somebody ) was much less as opposed to somebody who wasn’t young, or female, or with all their teeth.

So now the courts have to decide who is attractive and who isn’t? The courts have to keep a scale of just how attractive defendants are and adjust the punishments accordingly? They have to ascertain the sexual orientation of a 14-year-old boy so that they can increase the punishment if the offender is one gender and decrease it if the offender is the other?

Too right. We’ve been told that girls mature more quickly, and that a 14-year-old girl is more emotionally mature and has better language skills than a boy of the same age. Consequently, a boy is plainly less able to give informed consent and less able to deal with the emotional ramifications of under-age sex, and the perp should have the book thrown at her.

Otherwise, for instance, teenage boys who are made the sex toys of predatory women will be convinced they’ve been done a favour and should be fucking grateful for it. :rolleyes:

Hell, if you’re thinking that way, you could use this argument to say she should be punished more strongly than a 60-year-old toothless, fat teacher. After all, she could land a whole mess of attractive men of legal age, so she’s gotta be a real sicko to go after some barely pubescent student. Meanwhile, the stereotypical older and ugly teacher wouldn’t theoretically be able to get any except by going to an impressionable student over whom she had some measure of control. :rolleyes:

But we supposedly punish people based on how much harm they cause, NOT how “sicko” we consider them to be. If you don’t like this consequence of our system, then how do you propose we gauge the magnitude of crimes? By their public approval ratings? A lot of people would consider certain fringe sexual practices to be extremely “sicko”, yet they are perfectly legal.
