Not to be nosy (but I guess I am), what are the legalities of your extended family situation? I know it doesn’t really make a difference…I’m just curious.

Congratulations to all of you! Lee, I’m very happy for you. And I see in the fact of Kelly’s being male-fertile, despite what the hormonal treatments were supposed to do, a small miracle (in the sense of probability-bending) for the extended happiness of all of you.
Kalhoun, in most jurisdictions the legalities are that lee and Mr. Lee are married, the child is presumed to be a legitimate child of the mother and the man she’s married to, KellyM has no legal relationship to them, and any of the three can act to seek “filiation” – to have KellyM recognized as legal father to the child – if they so desire.
Please note that that’s not discussing how they’ve structured their family or the emotional bonds they may feel towards each other, but is merely what the law recognizes and will permit. Nor is it a definite statement of their particular situation, just the generalities on most states’ way of handling any such situation (married couple, third party, child born to couple with question of third party’s involvement, with no reference to who knew and/or approved of what nor to Kelly’s transsexual status) .

Can KellyM go down on the birth certificate as the legal father, even though Husband is Lee’s baby’s “presumed” father? Did that make sense?
