A forum here called “In My Humble Opinion”, where you get opinions rather than definitive answers. To get a definitive answer, you probably need to talk to a lawyer in your jurisdiction.
:smack: Oh I’m sorry. I was hoping that someone that has ever built a privacy fence and or worked for a general contractor that built a fence was on here. I would think that anyone that has worked for a licenced contractor should know the laws concerning building a wooden privacy fence would be able to give me a definitive answer. Do you want me to re-word it or just delete it and run it IMHO?
It’s already been moved, so you don’t need to run it again. However, the general policy here is that questions about real-life situations involving law go in IMHO.
Even such a person wouldn’t be able to give you a definitive answer, because so much of this depends on the specific ordinances in your town (which you didn’t identify). So the more general responses you got are probably the best you can expect online.
My town is identified in my profile name and in several other comments on this thred… Nampa Id.
Well then, what do you actually KNOW about the distance from your wall to your property line? It seems a little weird to think that it’s not possible (pre-fence) to comfortably walk around the outside of your house without technically trespassing onto your neighbor’s property.
The link points to a pdf file. Do you have Acrobat Reader? Or is your browser blocking pdf loads - it opens fine for me.
In my neighborhood all backyards are fenced, and we recently went in with some neighbors to update our fences and make them taller. (We were originally opposed but it turns out to be a good idea.) Your situation would not be legal here. I also wonder where your property line runs.
It is unlikely that someone knowledgeable about your local ordinances will show up here.
In order for me to KNOW the distance from my wall to the property line I would have to pay a surveyor. I’m not going to spend any money on HIS project! I am glad that I don’t have to look at his property anymore!!! I am just concerned on the facts that I can no longer use 3 different windows in 2 different rooms to escape in case of a fire. AND I believe that his fence could be a fire danger to me and my home because of the material it is made of, how tall it is and how close it is to my wall.
Thanks!!! I downloaded adobe reader in order to look at the file earlier. After I downloaded it, I tried to see it and it still didn’t work. I just tried it again and IT WORKED. I quess that I had to go offline and then return in order for it to work. Now that I have seen it, I printed it and I will now uninstall it. I don’t trust adobe!!!
OK thank you.
remember You’re not using your money for his project
- Check with the lawyer that helped on your house sale - he might have the survey for you
- If the fence is NOT on the survey line - you will be spending money to protect your property, if you don’t do anything about it, the fence can become the new property line
- Like you say - the fence blocks your windows - this is not acceptable, the easiest way to get it moved is to prove it’s on your property. If it is on your property, tear it down at your convenience
I’m curious, why does your neighbor hate you?
It costs nothing to go to county code enforcement and discover the actual facts as they apply to you and your neighbour.
Whether or not blocking your windows will be an issue depends on the code in your county. Whether being 8’ high, blocks all sun and air matter, all depend on how your county code is written and enforced.
Also since its a privacy structure, beside an existing fence may mean a lot of the general information you’ve been told regarding fencing bilaws may not apply.
The solution, if you’re looking for more than conjecture, is to contact the county office for solid answers.
Good Luck!
Doesn’t one neighbor on the spectrum from “doesn’t communicate with you much” to “actively tries to poison your life there” pretty much come with any property? :smack:
Almost everyone here has told you exactly what you need to do: Go down to your municipality’s Planning/Building department and talk to someone.
HAVE YOU DONE THAT???
Since the laws vary by state, county, and town, it’s unlikely anyone here knows the applicable laws for YOU. That’s why folks have suggested you research this.
Don’t trust Flash, but the reader is okay, I think. Glad it worked.
No, not really. But I can understand why you might experience a somewhat greater than average incidence of such neighbors.
nampa Mike, go to this link –> http://id-nampa.civicplus.com/index.aspx?NID=151 for your town’s Code Compliance Dept. There is a “Report A Concern” link near the top right corner. Click on that, submit your information, and they will contact you to resolve this.
Not really. But there have been many threads here alone where quite a few posters have chimed in about their shitty neighbors over the years. Me, I’ve had far more problems with harpies and shrews.
