Classic Trumpian sleight of hand. Whenever he wants to pretend that he has support among African-Americans, he trots out the black unemployment rate. (You just know that if there was a way he could have pumped up the economy without African-Americans seeing any benefit at all, he’d have been fine with that.)
Similarly, whenever he tries to pretend that he cares about climate change he talks about how much he loves clean air and clean water. That’s Not. The Same. Thing.

And he won’t- for now? That’s a fascist, through and through. If someone should be prosecuted, you prosecute them. If they shouldn’t, then you don’t. You don’t hold it over their heads. That’s what authoritarians do. They use the law as a cudgel against their political opponents, rather than for the purpose of promoting justice and order.
