Canada: Ontario: Failure to yield to pedestrian.

I’m pretty sure that in this situation, failure to yield right-of-way to a pedestrian would still apply - depending on local regulations, that is.

Apparently, no one from England has posted on this. I was astonished to discover that in England, the only time a pedestrian has the right of way is if there is pedestrian crossing light. If you are turning right on a green, a pedestrian crossing with the green has to get out of your way as you have right of way. In fact, my informant was incredulous that the law could be different anywhere in the world. I told him it was certainly different anywhere in North America.

There was some speculation that this is all part of the class system. Upper classes traveled in carriages and lower on foot and it was clear who had to yield to whom.

In the UK, pedestrians have right of way when you’re turning into a road. Although, I’ve never heard of a driver getting ticketed for ignoring it (and most people do), but if you were to knock someone over, it would be your fault. If there are traffic lights then cars/pedestrians should obey the lights, cars could get ticketed for running a red light and some junctions have cameras.

I don’t think we have jaywalking laws in the UK, but pedestrians tend to cross when and where they feel like it.

Last summer I asked a Brit and not only did he affirm that pedestrians do not have the right of way over turning cars when both have the green light, but he thought that the idea that they did in North America was bizarre. An Australian who overheard the conversation agreed that it was the same in Australia. Can you give a cite to your claim? Mine was just a casual conversation, but I know what was said.

Sounds like he was only talking about Traffic light controlled junctions, cars and pedestrians should obey lights.

At a junction. When crossing the road, look out for traffic turning into the road, especially from behind you. If you have started crossing and traffic wants to turn into the road, you have priority and they should give way (see Rule 170).

Highway Traffic Act, Section 140 & 141 is the relevant law. To the OP, read it before you consider fighting the ticket. As well, if you are in Toronto, expect the cop to show up.
