I find the “ambush” technique of the OP particularly interesting. There’s a thread about a girl being videotaped having sex, with not even a hint of being impaired in any way at the time.
Hydrocortisone finds a link that may indicate otherwise. Does he/she bring that up in the original thread, to those who likely have no idea of the involvement of drugs and/or alcohol? Of course not. Has anyone actually seen the tape? The only cite we have that alleges that may be non-consensual sex is an article by the New York Post stating that it looks like she isn’t conscious.
No other media outlet has statements to this effect with the exception of stories attributing it to the New York Post.
This article states that she was aware that the tape was being made. If anyone has seen it does it look like she is incapacitated? Every picture of her I’ve ever seen shows her with a vapid look. Maybe that it was people are seeing in the videotape.

I don’t agree with the OP, but it’s kind of stupid to tell someone to take the fight to somewhere it’s not allowed.
Is it necessarily wrong if you like getting drunk and high and having sex while both? It might be illegal if the consent comes only when incapacitated, but what if it comes before (sober) during (not sober) and after (sober again)? An interesting legal riddle here.

When I was a geeky teenager and thus relegated the role of “friend,” I was made privy to the fact that even the most ordinary young women have at least that one summer when they go out and “do all the sex.” That includes a lot of stuff they won’t be interested in later after the first year of marriage, such as polaroid/videotaped/webcammed exhibitionism. If voluntary intoxication prevents Paris Hilton from consenting to sex, is it possible for her to consent to sex? What would her opiate, alcohol, nicotine, cocaine balance have to be exactly? As she and Rick were dating, and Paris Hilton is richer than God, I think it’s safe to assume that she wasn’t raped in any meaningful sense.
Claiming it in cases like this could diminish the impact when people hear about actual rapes of a horribly violent nature – which do happen all the time. These drunken mistake “oops” rapes are just not in the same category as the real crime that does still happen all the time. Withdrawing consent should be done before the sex act has been consumated, or years later.
The issue of selling her likeness in lots of interesting postions without her consent (different consent) is another matter entirely. Rick should not make a cent on this.
I absolutely agree that rick should not make a penny by selling the rights to this (is it even Rick who is selling the rights? I thought the tape was stolen ala the pammy video).
but from what I’ve read, it doesn’t convicne me she was raped, or this was done without her consent.
