Umm, the next Congress will convene on Jan 3, 2007. So, he won’t have to resign.
This actually makes some sense. House seats can’t be filled by appointment from the Governor. Thus, his district would be without representation.
It is cheaper for this slimeball to retain his salary than for his district to have a special election to fill a seat from now until Jan. 3, 2007.

Apparently, both parties agree that the first order of business in the lame-duck Congress will be to expel Ney. Good.

They wouldn’t have an election now; it’s too close. Neither is Foley’s seat having a special election.
Does anyone know the drill on that? Is it up to the state when to have an election to replace a resigning Representative or Senator?

The Governor can appoint a Senator to serve until the next election. A represtentative can’t be appointed. A special election would have to be held
