It seems the money laundering charge is hot on the heels of a move to dismiss. It appears that when DeLay allegedly conspired to launder money, it wasn’t illegal! Or something. Anyway, my guess now is Earl didn’t feel he had enough for to charge him with the full monty, had an “oh shit” moment with this move to dismiss, and is now gonna aim high since he’s got an outside chance of winning with what evidence is available.
My prediction: They know DeLay’s dirty, but they don’t have the goods to convict (now that the original charge could be dismissed). They’ll go to trial for outright laundering, and lose. DeLay walks, but it still may cost him.

Ehh, at this point I’m really unsure. If he’s guilty, the public humiliation probably won’t matter. But if he isn’t, the backlash is going to be far more fierce for this. I’m not so sure about this Earl guy (wasn’t really sure before, but now have some doubts).
Too bad justice moves so slowly. We won’t know anything for weeks…

I am rather glad for the warrant. I have seen far too many perp walks in the news and commentary on them that seem to indicate that the humiliating spectacle is somehow proof of guilt. If he is found not guilty, then in the future he can be trotted out as an example of why humiliating the accused is not proof of guilt.

There’s been some speculation on what evidence Earle had that linked Delay to a conspiracy to evade campaign finance laws. It’s now come out that Delay himself, in a meeting with Earle, admitted to taking part in the scheme:
Asked what his role was in creating TRMPAC, DeLay said it was his vision and his idea, the sources said. But he reiterated that he knew only in general terms about its day-to-day operations. DeLay said he was also generally aware of a plan to shift money between Texas and Washington. It called for pulling together $190,000, sending it up to Washington and getting the same amount sent back to Texas for state election campaigns.
According to matching accounts provided separately by the sources, DeLay was asked whether such a deal happened and responded yes. Asked if he knew beforehand that the deal was going to happen, DeLay said yes. Asked how he knew, DeLay said that his longtime political adviser, Ellis, came into his office, told him it was planned and asked DeLay what he thought. DeLay told Earle that he recalled saying, “Fine.” He added that he knew it was corporate money but said it was fine because he thought it was legal.

I mentioned in a Great Debates thread that I was putting together a lesson plan on Bias in the Media, using Delay as an object example. The plan went great: it’s rare to find a story in which each side is vilifying the other side this much (at least, outside of a major election year). Thanks, Delay!
