Look, I completely understand that it is completely possible to somewhat reasonably think that someone is not under the age of consent (although I will say that the thousands of examples that are always trotted out in these cases are extremely rare here in real life). And, in those excruciatingly rare cases, the “defendant” should not have to suffer a conviction.

This opposite reaction is the reason that Dio is getting pitted. His stated position is that there is no way for a minor to be mistaken for someone legally able to consent and that no matter the circumstances they should get

It’s also been pointed out that in some places that if reasonable steps are taken then there is no crime

In Indiana, the offense of a person over 18 having sex with someone who is over 14 but under 16 is called Sexual Misconduct with a Minor. It is covered in I.C. 35-42-4-9.

(c) It is a defense that the accused person reasonably believed that the child was sixteen (16) years of age or older at the time of the conduct

But again this hasn’t mattered to DIo. Who continues to state that anyone pushing to change laws in other states just wants to help out the pedos.
