ebay disputes

So I bought a magazine from some guy on April 2, paid immediately, never got it. I’ve emailed him 5 times about it. After the second or third, he responded with something like “Oh I didn’t answer you because I thought you got it. What’s your mailing address again?” Then nothing–no magazine and no more answers to my emails. He is curiously selling the exact same 20-year-old magazine again.

So on Saturday I said he could have 24 hours to contact me and if not I was filing a dispute, which I did. For some reason it goes to Paypal for a dispute, not ebay, which kind of annoys me but whatevs.

My question is: how do these things work out usually; and I have not left feedback yet. Do I ding him now or wait for the dispute to be resolved? And even then, I’m not expected to leave positive feedback am I? The guy is a dick. Is he now prevented from leaving me negative? Or can he just go on now that he knows I’ve filed and dispute and say bad things about me that have no basis in reality?

Anyway, tell me your horrible ebay stories. Thanks.

I may be wrong, but it is my understanding that eBay no longer permits sellers to leave retaliatory negative feedback for buyers.

The dispute with Paypal will take a couple weeks unless he responds and refunds your money.

If he does nothing Paypal will attempt to get your refund from his account but if there is not money in it then you are pretty much screwed but Paypal will flag his account and most likely ban it.

I would wait a couple days to a week and see if he steps up and refunds the money or sends you the item.

If not then leave a negative. He may try to do the same with other buyers and they won’t know unless negative feedback is left.
