I saw an interview with the “dad.” He sounded like he was brain-damaged (which, as an MMA fighter, he probably is).
There was a video, shortly after he was identified, which went into some detail about his parents’ criminal records, but I can’t find it now. This person didn’t have a chance.
Barring evidence they identified as non binary prior to the attack, I suspect their lawyer is making this up in a trolling bid to gain sympathy and attack progressive values, but we’ll see.
Here is where it might be helpful to distinguish between empathy and sympathy. Because I do have empathy, in the sense that I am sure they are in a lot of pain and discomfort and are probably an absolute mess right now, having got the shit beat out of them at a LGBTQ nightclub. But far from feeling sympathy for them, I am quite pleased to know they are going to have to deal with their very painful and obvious (but in no way life-shortening) injuries while knowing they are a complete failure and their life is actually worse than over right now. With any luck, it wont actually be over for a long, long time. And they can sit and think about what utter garbage they are until they either die and/or feel genuine remorse (hey, I can dream, can’t I?).
While it’s okay to question whether this person is really non-binary, it’s not okay to casually misgender them by using “he” pronouns.
Also, the brunt of your comment is an insult to non-binary people. (Although a confused one, as non-binary people date men, women, and other non-binary people, just like everyone else.) Please try to stay respectful to the non-binary among us.

I’ve seen this suggested and it is a possibility. I don’t know anything about the lawyers, or why they’d try to do that, but here we are.
It’s also possible the kid was/is non-binary but was afraid to come out (see the interview with the father to gain some understanding why that might be the case) but now they’re locked up an accused of mass murder no longer feel they have anything to lose. And they don’t have to worry about dad beating the shit out of them in an attempt to beat out the gay so they can come out now. I mean, we’re talking about a man whose more relieved his kid isn’t gay than upset at the fact the kid killed a bunch of people.
Or maybe the young person/their lawyers are somehow convinced that if they’re LGBTQ themself it will get them out of the hate crime charges (it won’t).
Someone who knew the shooter beforehand stated they didn’t think/had no knowledge of the person being non-binary. On the other hand, being in the closet is a thing.
I don’t know what to believe here and await further information.

Actually, he IS a reality show participant, having appeared on those two shows. Give him credit for fulfilling an ambition I guess. He’s just not the sort that gets invited to nice parties.
I don’t think they ever had a chance to be whole given the environment in which they grew up, but at this point they’re a very clearly a danger to other people. They should have had help long before, but they didn’t. Now, at best, they’ll spend the rest of their life in prison where they won’t get help either. It’s tragic, but I find it difficult to care given the dead and maimed.

305 counts. Hot damn! Whelp, I’m 99% certain they won’t get the death penalty, and consecutive life sentences without parole are meaningless, but I do admit a certain morbid curiosity. Not that it will bring back the loved ones taken by the schmuck, but at least we can expect he’ll never be able to hurt any more innocents.
