You’d think…
FBI Search and Seizure at Trump's Mar-A-Lago Residence, August 8, 2022, Case Dismissed July 15, 2024
The idea of TFG paying fair market value for anything has me laughing so hard I almost can’t catch my breath. Particularly for something he considers a gift to him personally. HI-larious!
While Trump’s team had little hope of overturning the ruling, the decision not to attempt an appeal… is somewhat surprising. After the FBI searched Mar-a-Lago, a top Trump adviser familiar with his legal strategy said Trump would probably “appeal everything to the Supreme Court,” adding, “We’re fighting everything.”
Lifting the restrictions on the Justice Department’s investigation could allow investigators to proceed with the probe more quickly, finally allowing them to review thousands of pages of documents that had been kept from them pending a review for privilege issues by the special master.
“The law is clear. We cannot write a rule that allows any subject of a search warrant to block government investigations after the execution of the warrant. Nor can we write a rule that allows only former presidents to do so. Either approach would be a radical reordering of our caselaw limiting the federal courts’ involvement in criminal investigations. And both would violate bedrock separation-of-powers limitations,” the panel wrote.
Maybe he didn’t want to get another brusque slap by the SCOTUS so soon after the last one.
Still, I’m genuinely astonished.
Wow, I’m really surprised. The king of court delays didn’t file an appeal? I guess this means he could still appeal to the SCOTUS, but it’s surprising to me that he wouldn’t have taken this additional step before that just to get another delay of however many months.
It’s almost making me wonder if he really is scared he’s going to be indicted and is now trying the “See, I’m being totally cooperative!” tack to try to get out of it since stonewalling didn’t get the DOJ off his back like he expected. Or maybe it’s just because his lawyers are finally refusing to take actions that could get them in trouble personally.
I haven’t seen it reported in any mainstream media source and he’s still got 20 minutes.
Let’s wait and see for sure.
He’s not being totally cooperative, because no one on his team is willing to go on record as official custodian of record. As I posted in the schadenfreude thread,
Filing an application to appeal to the Supreme Court won’t get the lawyers in trouble. That’s what lawyers do in major cases.
I’m not expecting them to get in trouble for going to the SCOTUS but was thinking more about how his lawyers now all seem to be very reluctant to attest that all documents have been returned and wondering if that is making them hesitant about what course of action to recommend to their client?
I don’t know, I’m just spitballing since not filing an appeal anywhere and everywhere is so unusual for President Court Delay.
He’ll probably still appeal to SCOTUS, I’m assuming.
He’s still being totally uncooperative, but maybe he’s trying to seem like he is helping by having his storage shed searched and offering another couple of documents. He could have gotten a few more months out of the 11th Circuit.
The Special Counsel lost his appeal (to Trump) once the top secret documents were removed from his review. The second that happened, he was irrelevant from Trump’s POV and worse: a daily expense.
Not surprised he didn’t appeal. Once the TS documents were carved out, the SM served no purpose.
You meant to say Special Master (Dearie), not Special Counsel (Jack Smith). Smith is still on the case and hitting Trump hard.
No, I don’t think so. The penalty is $1000, or prison, or both. It’s up to the judge which one he gets. If he sends Trump to prison, Trump can’t choose to pay the $1000 instead.
As always, the rule is: Go with what I mean, not what I say.
6 months in prison just might give Trump an idea of what he’s looking at for the rest of his crimes. Would the riots of the MAGA’s be worth it? I think so. We have to start somewhere.
There are no ‘Take Backs’ Trump. Once you’ve done the crime, you do the time. Perhaps he and Putin can retire in Venezuela.
It looks like the request is to hold the team in contempt, not any individual, let alone Trump himself. I’m not sure what that means for penalties.
I don’t have the article open in front of me but I’m assuming it was today’s wapo where someone was quoted as saying (approximately) “no one wants to put their head in the custodian noose.” Which I totally get.
MAGA isn’t going to riot. They will barely protest. You may have a couple of lone-nuts, but there will be neither an organized or spontaneous mass protest/riot.
That was the money quote.
Well, it certainly won’t be organized. That would take planning and some education.
More likely they would go to Saudi Arabia. With no extradition treaty to the US and the way they cater to the rich it’s a natural choice for both of them. Much more secure than Venezuela.
Yes, I wondered about this myself. What does it mean in terms of sanctions to hold the team in contempt?
