FBI Search and Seizure at Trump's Mar-A-Lago Residence, August 8, 2022, Case Dismissed July 15, 2024

Unfortunately, there is no similar procedure in Federal Court. (I have often wished there was). Judges are reassigned from time to time, especially early in the litigation, but a party has no right to bump a judge.

Also, didn’t he in fact preside over the largest tax cuts?

I count two truths.

Ugh. That seriously sucks. They have no recourse if this case is assigned to Cannon, then?

ETA: And thanks for jumping in and correcting my ignorance!

Do you know how federal judges are assigned? And if it’s random, how large is the pool for this case?

And the charade begins. Trump seems to be protected at every critical moment, as if by magic. But it’s not magic, it’s a charade of justice.

I hope he lives long enough to see a Black trump.

Half-truth, at best.

The cuts are not uniform and for lower and middle incomes, more or less have already disappeared and may have resulted in increased average taxes by now.

It’s supposed to be random, but there are provisions for “related cases” to be assigned to the same judge.

Thanks. I understand that Cannon’s rulings can be appealed and overturned, but what if she attempts to slow walk the trial as much as possible? Suppose she sets a trial date (or whatever) of 2025. Can that be appealed?

It’s been confirmed that Aileen Cannon is indeed the judge who will be presiding over the case.

In other news, PAB has fired several of his lawyers and hired new ones. From his pretend social media account:

For purposes of fighting the Greatest Witch Hunt of all time, now moving to the Florida Courts, I will be represented by Todd Blanche, Esq., and a firm to be named later. I want to thank Jim Trusty and John Rowley for their work, but they were up against a very dishonest, corrupt, evil, and “sick” group of people, the likes of which has not been seen before. We will be announcing additional lawyers in the coming days. When will Joe Biden be Indicted for his many crimes against our Nation? MAGA!

Trusty is saying he quit, wasn’t fired.

Well alrighty then, that’s a wrap. This will all be performative until the appeal in a year or two.

Since it appears she was assigned because of her previous experience with this case, tip of the hat to the Trump legal team for judge shopping for her in the first place. Turns out that was pretty darn savvy.

So, not only does he refer to himself in the third-person. He now refers to himself as more than one person.

“Individual One+,” perhaps.

I’d like to know more about Judge Cannon before I freak out. Yes, she made some really bad rulings and was slapped down for it. However, she is a former federal prosecutor (7 years) and might actually be willing to let the Justice Department do their job in this case. Federal judges usually have a lot of respect for the Justice Department lawyers and see them every day in court. I’m holding out hope that she will be fair in this case, despite her previous rulings. At this point, it’s only “hope” and not a prediction.

She’s also beholden to Trump for her current position.

I too think it’s too soon to assume it’s a setup, unless someone can point to something impugning Cannon’s character.

It IS possible to be a Trump supporter and apply the law appropriately.

Except that’s precisely what she didn’t do when dealing with the Special Master issue.

Walt Nauta has also been charged in the documents case.

This, exactly. She had to be overruled several times by very conservative judges for her whackadoodle rulings in favor of Trump that were completely contrary to the law.

A good conman needs to know when to stop.

I’m not nearly so sanguine as you, based on her prior nutty rulings. To have been slapped hard by the Eleventh Circuit not once, but twice… it just does not bode well.

The only thing I’m interested to know at this point is what Smith’s team is going to do about it. If this is in fact the custom and practice of the Southern District of Florida, they surely would have been aware of the potential for Cannon’s assignment to their case. Presumably they have some plan of action to deal with it.

We both know if she ends up handling this case, she has a million ways to influence its outcome. From foot-dragging on scheduling proceedings to favoring the defense in voir dire and challenges to jurors, as well as her choices at sentencing, she will control what happens to Trump.

It’s a really ugly development and one for which I hope Smith’s team is prepared.

Perhaps she was just trying overly hard to be more than fair with Donald when she made the special master ruling. That doesn’t mean she won’t run a fair trial. She certainly isn’t going to do this:

PROSECUTOR: We’d like to start presenting evidence…
DEFENSE: I object your honor!
CANNON: On what grounds?
DEFENSE: It makes my client look guilty!
CANNON: Sustained.

That isn’t going to happen. The prosecution will present an air tight case and the jury will decide. She’ll doubtlessly follow the lesser end of the sentencing guidelines but still this isn’t the end of the world.

These indictments are like city buses- if you don’t like the way this one is going, there’ll be another one coming by shortly.
