You’re probably right on double jeopardy, but Smith will have to appeal, get this reversed, and then it would be remanded back to Judge Cannon. The government can ask that it be reassigned to a different judge, but that would be an unusual ruling by the Court of Appeals (justified, in my opinion, but unlikely).

This case should have been the slam dunk, open and shut, easy peasy case that was heard and adjudicated last year. The facts were easy to understand and pretty hard to argue against. I am infuriated. Seriously shaking furious. Damn corrupt judge.

I haven’t attempted to understand the arguments about the appointment issue, but I will say it seems ironic that a special counsel is appointed for Trump’s protection, to remove “Biden’s Justice Department” from the prosecution, and it bites them in the ass.

My position was recently the subject of a SCt decision (Lucia 138 SCt 2044) holding us to be “inferior officers.”

Struck me to be a bullshit argument/decision then, as it does now. Don’t be so certain that the Supremes will overturn Loose Cannon.

The SCOTUS may not, but will it even get to them? It goes to the 11th first, right?

Won’t it go to the 11th Circuit first? I know Alito recently mentioned that he thought the appointment of Special Councils was unconstitutional, but it seemed like that was an unpopular opinion. Will the Supremes really want every single case brought by every special council overturned in one fell swoop? I know they don’t honor precedent, but damn, this has a LOT of precedent.

**correcting myself, it was Thomas, not Alito who held that the special councils were unconstitutional unless appointed by Congress.

I’m guessing Cannon wanted to dismiss this case while the news was still mainly covering the shooting in Pennsylvania, so as to get minimal attention.

thomas did tip his hand regarding special councels. cannon is saying jack smith is not authorized to conduct the prosecution.

as i understand it there are 2 ways to go.

  1. appeal to 11th circuit.
  2. refile with a different prosecutor.

Is this how it works or will he have to appeal this to the 11th circuit? (This has been talked about as what Cannon was trying to avoid by not quite stepping over the line into blatantly doing Trump’s doing, which is a line that was just leaped over with aplomb :frowning_face: )
