But the problem is that Garland is in a “damned if you do damned if you don’t” type situation. If he doesn’t release everything related to the investigation then he gets accused of not being transparent, but if he did post a press release that said Trump is being investigated for treason, then he would be accused of publicizing unproven allegations to influence an election.
Garland’s method to avoid partisanship is to not make Comey’s mistakes is to stay out of the public sphere as much as possible and release only what is absolutely necessary, when it is absolutely necessary.
Yep, I don’t share the concern about a special master being appointed. It does seem moot, however, as the DOJ is moving forward after their own review of the documents.
I am not opposed to the appointment of a special master in the abstract, but I am in this case for the stated and underlying reasons they’re requesting one.
Stated reasons: to remove and return items that are under attorney-client privilege and executive privilege. He does not have any executive privileges, despite his most fervent wishing and bleating about it. And if there are in fact documents that fall under attorney-client privileges they will either be returned or can be ruled inadmissible in the event of a trial.
How they got there is pretty much beside the point now. He would still need to explain why he stonewalled returning them to NARA and/or why he claimed everything had been returned when it wasn’t. But yeah, he’s really starting to sound desperate now.
I am genuinely surprised TFG has not blamed Barron in public yet for the stolen documents. Hastily adding in his defense that he was a minor back then and so immune from prosecution. And pardoning him a posteriori. But it is his fault! <crosses arms, blows cheeks, looks miffed.>

Yup. The Right is crying that this is merely a political hit, and so far Biden has been “I don’t know. Don’t ask me.” Feeding the Right’s talking point is a terrible idea.
There is another possibility. That is if you are willing to believe that many Republicans are devoted tribal members who have a much higher degree of loyalty to each other than to the whole of society. It would also require believing that some Republicans are capable of corruption and might misuse information or documents to advance their partisan desires. But if you can comprehend some of those GOP members do such things . . . I found this sentence very interesting:

A detailed list of materials taken might be an excellent way to find out what the prosecution knows. You know, if it was at all possible for any judge, especially one appointed by the accused, to corruptly provide that information to the subject of the investigation secretly.
But we are all sure that could never happen, not in our system of laws.
This is just my opinion of the matter at hand, but I am willing to back it up by putting skin in the game. If Donald J. Trump is found guilty of any charges from this seizure of documents (not including the Georgia election tampering or the January 6th Coup attempt which may be referenced in the seized documents), anything relating to 18 USC 793, 18 USC 2071, or 18 USC 1519, within one year-- I will donate fifty dollars to a mutually agreed upon charity. Are you willing to pledge the same amount if Trump is not charged, or charged but charges dropped, or if he is found not guilty/not responsible within that same same year time frame?

Team can we lay off the “the right’s gonna get upset” comments from, like, here until eternity? These people whine about ‘happy holidays’. They whine about Confederate statue removals. Of course they’re gonna whine, they are the American conservative right. That’s what they do, it’s what they’ve been doing since Limbaugh broke out of Sacramento, it is what they are going to do until we learn to ignore their keening.
I know, nothing really new, but he obviously trying to rouse the rabble, at least that is what it seems to me.
