FSC ruling allows counties to pick which votes to count?

The FSC ruling ordered that Gore be given votes from the partial recount in Miami-Dade county. Some precincts were countd, others were not. In effect, this gives the county election board the authority to decide those precincts where the ballots will be counted and those precincts whose ballots can be ignored.

How does this affect future elections? Can county election boards now select whose votes they want to count? The FSC ruling did point out that valid votes can be legally ignored.
