Donohue, (from the Catholic League–a “league” of a half dozen office workers and anyone he can con into sending him money), is an idiot. His premise is that anyone doing anything vaguely religious should be entitled to do so and wants to accuse the ACLU of hypocrisy for not supporting Davis.
Of course, the ACLU has defended a number of people engaged n religious activities, but that is not what Davis is doing. Her action is to attempt to use her claimed religious beliefs to enforce her beliefs, (purportedly religious), on others through her power as the representative of the state. She is trying to enforce a theocratic action and that is in direct violation of the Constitution. Prisoners attempting to worship are protected by the bolded portion of the following section of the amendment:
" Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof, . . ."
Prisoners wishing to pray are engaged in the free exercise of their religion.
A clerk imposing her own religious views on a bureaucratic procedure of the state is attmepting the establishment of a religion.
But, as noted, Donohue is an idiot.

The licenses they’ve been issuing since Thursday didn’t have her name on them, which was a little disappointing to me because that’s what she said she wanted at one point. (It was also disappointing because the deputies had no imagination and changed it from “Kim Davis, Rowan County County Clerk” to the tongue-twister “Rowan County, Rowan County County Clerk.” I mean come on people!)
But that does take away her excuse for interfering. Her deputies can issue licenses and her name doesn’t have to be on them. She said in the past that she’d be ok with that. There should be no logical reason for her interfering again. Not that that would matter to her or her supporters, of course.
I suppose it’s possible that there are right-wing operatives encouraging her to continue to be obstinate (“you must hold fast in the name of Christ!”) so that they can continue to milk this.
Also, fame, and the desire to remain in the limelight (and the profits that can come from all of that), can be powerful incentives for misbehavior.
I guess we’ll know in a few days what her plans are. Maybe she doesn’t even know at this point.
Technically - thats not a signature and would take legislation to make that legal - otherwise - she could have allowed that all along.
