Here is an article that specifically said she’d be ok of her name was taken off, but maybe the attorney is trying to downplay the fact that they also wanted “her authority” taken off.

The Kentucky county clerk, jailed for failing to follow a judge’s orders to issue marriage licenses to same-sex couples, wants her name removed from the marriage certificates, her attorney Matthew Staver told ABC News.
“She has a very strong conscience and she’s just asking for a simple remedy, and that is, remove her name from the certificate and all will be well,” Staver said. “That simple remedy has simply been ignored by the court and by the governor and that’s what should have been done.
“I think it’s reprehensible that she’s in jail for this when a simple fix could have been easily handled.”
Marriage licenses in Kentucky are required to include an authorization statement of the county clerk issuing the license. Some state lawmakers, as well as the Kentucky County Clerks Association, have suggesting having clerks’ names removed from marriage licenses.*
I like that its “ignored by the court” - which couldnt change it if it wanted to, since there is no legal precendant and its not the case in front of them - that would be in fact ‘creating new law’ and that the Govener is ignoring it - even tho he’s on record as having told them “do it or resign”.
Exactly. Don’t call out the state legislature that can, you know, make it legal and all. Can the Governor make a change to the forms through an executive order until the legislature meets?
Did they not pay attention in high school or even junior high civics? Did they not learn that US Supreme Court case law trumps any state statutory laws, including state constitutions? :smack:
Bah. I don’t think they should cave in to her. If she does not want her name on legal forms, she should resign. Are we going to make special exceptions for every one of these goofballs?
This whole spate of “religious freedom” cases we’re seeing recently - this, Hobby Lobby, etc. - may be another Republican backdoor attempt to disrupt so-called “big government” by making it impossible to enforce anything because of someone claiming “religious freedom”. Oh, I think the individuals, like Ms Davis, are sincere enough (if misguided), but we know that there are interests who like to tie the legislative and judicial branches in knots, seemingly for the hell of it.
Well, that’s taking slippery slope a bit far IMHO. And I seriously doubt that the clerk records fishing licenses. They don’t in Colorado anyway. And each person would have their own license.
But there are plenty of documents where both spouses are typically on the deed. Property ownership for instance. While not mentioned in the bible (AFAIK) what if this then becomes ‘icky’ to these fanatics. They twist the bible into such contortions, and interpret the parts they like, the way they like.
Or how about medical release forms. Will they frown that Mr Jones relationship to Mr Jones is spouse?
Situations involving inheritance could become a biggy too.
That’s why I love this place. I’ve never before thought to contemplate the implications of gay fishing. Soon, I will have a position on it, though tentatively I support it.
