I think it is pathetic when I am called ignorant and a fool on this board. Especially from this idiot from California called bearflag. He must be a person with a small Johnson and a big SUV who drives with his brights on a beautiful summer day. A person who is dominating of his wife and whose children are scared of.

I have been driving for 20 years now in the United States and several East Asian nations. I have a Commercial Driver’s license as well as an International License. I have driven motorbikes as well as cars.

This is the truth of the highway, I don’t give a fatfuck what the California or the North Dakota driver handbook states:

  1. It is illegal to drive over posted speed limit.

  2. It is a courtesy (not a god damn law) for slower traffic to drive the right lane. believe it or not, I do this. That’s not my point.

  3. I agree that someone driving 5 MPH under posted limit should drive on the right lane, only because of the placement of the shoulder.

  4. Since it is not legal for me to drive over the posted limit, if I am driving at that limit, I will drive on the left hand lane.

  5. The speed of the “flow of traffic” varies and is subjective. How does the police or the driver to judge the flow of traffic in any given situation? So there must be a determination of what that flow must and should be. This is why we have speed limits (duh!)

  6. If foolish assholes like bearflag roar behind me breaking the law and exceeding posted limit, I AM NOT going to move out of your way. Please use the other lane. I will move for law enforcement, fire trucks, ambulances, and school busses. If you are hauling ass because you are late and feel that you are lacking in your ability to go around me safely, I say TOUGH SHIT.

  7. The speed limit is the cruise speed, and the flow of speed travelled. Anything above this is illegal. This is the same mentality as the left lane as the “beer lane”, if you are drinking beer, drive on the left. It is illegal to drink and drive, but someone who is not drinking a beer needs to be out of the beer lane, even if the non- drinker is following the law and is driving in a safe and orderly fashion. Someone travelling over the speed limit is truly taking his life and my safety into his/her’s own hands. And I am selfish and reckless?

  8. If I am doing the speed limit in the left lane and have speeders behind me lined up and a cop stops me for failing to lead to “faster” traffic, he is condoning the faster traffic breaking the law. Who is more dangerous, the one who drives the limit or the speeder?

  9. FOR THE LAST TIME There is not a seperate speed limit for the left and right lane!!! The speed limit is the same no matter what lane travelled.

  10. Show me ONE TIME, anyone has gotten a ticket for “slow driving in the left lane”. It has never happened.

  11. There is a wonderful invention they put on cars, A TURN SIGNAL. Lane changing is safe boys and girls if you use this. You wont die in a deadly fireball by changing from right and left lanes.

On beautiful Long Island we have many, many, MANY roads where the speed limit is 10, 15 even 20 miles too low, as backed up by independant speed surveys, but because our politicians have their heads up their asses they do not respond to requests to raise the limits (the most notorious example being the Long Island Expressway; every so often one Assemblyman or another suggests raising it to 65 or 70, but that peters out for whatever reason (hint: ticket revenue) - so the situation is we have is everyone pretty much does 65-70mph on a ‘55mph’ (actually designed for 70-75) road very safely (er, during non-rush hours, of course), and it’s the asshats in the left lane fuzting along at the speed limit that ARE the very real danger.

The OP did not talk about people speeding insanely, he was specifically addressing those idiots who drive UNDER the speed limit and will not let people pass! People, quite obviously like you, despite you stating you travel the speed limit. You quite gleefully write about not letting people pass.

I think most of the posters here who admitted to being leadfoots agreed that we really couldn’t piss and moan about those folks doing the speed limit! I say again, we are talking about those who consistently drive UNDER the limit AND won’t let anyone around them, and MOST importantly, speed up when someone DOES attempt to pass them. I’ll bet you pull this shit too, grinning like a fucking maniac the whole damn time.

Oh, and I disagree that it’s always illegal to drive faster than the posted speed limit…

OK, now I have time, so here’s the story…

The basic speed law basically says that driver’s shall drive at reasonable speeds. The maximum speed law says basically that drivers shall not drive over 65 MPH.

Posted speed limits under 65 MPH are usually “prima facie” speed limits, not absolute maximum speed limits. If, based upon road surveys and conditions, it is reasonable and safe to drive over the posted speed limit, but under 65 MPH, then you are not violating the basic speed law or the maximum speed law, IMHO.

For example, let’s say I am driving 50 MPH on a wide street at 7 AM on a sunny Sunday morning in the summer with the sun to my back with no traffic or pedestrians anywhere. The road survey says the road was designed for safe travel at 55 MPH. The posted (“prima facie”) speed limit set by the local authorities is 40 MPH. I am exceeding the posted speed limit, but I am not violating the law.

So, again, Shep’s argument falls apart.
