I am so mad right now I could bite a nail in half.
Here’s the story:
On 11/23, I used Buy it Now to order sections of elk antler for my dogs to chew on. Ordered 6 pcs. for a total cost of $48 including shipping. The seller did not offer PayPal, so I sent him a check. He cashed it quickly and it cleared my bank on 11/27.
I still have not received the antler chews. I have written him multiple times, been promised shipment, and nothing. So, on 12/20 I opened a case against him. He wrote me a message thru eBay on the 21st saying the antlers had shipped. Today is the 29th and still nothing, so I escalated the case to eBay. Tonight I got this reply:
Hi papsett,
eBay Customer Support has reviewed the case and made a final decision. We’ve considered the case carefully and decided not to issue you a refund. We’re sorry this didn’t work out.
Decision:
This case has been decided in the seller’s favor.
“WE’RE SORRY THIS DIDN’T WORK OUT” ??? I’m out almost $50 bucks and that’s all they can say???
I am appealing the case. I don’t know what else to do. I am beyond angry and frustrated.
Anyone else have anything similar happen? Am I truly just out of luck?
I am contacting my credit union to see if they can reverse payment on the check. Any other suggestions?
I’m trying to view this auction to see if there’s anything odd about it, but there’s nothing on eBay that fits this. Nothing in November sold for anywhere near that $ amount, nothing sold on 11/23, and of all the sellers in November, all accepted Paypal. All have 100% positive feedback. Did you buy it off-site?
Is there any chance that he provided them proof of shipping, and they’re going to arrive in a day or two?
I know I shipped to my Secret Santa (see the MPSIMS thread) and my parcel arrived at the US post office on December 21 but wasn’t received by my giftee until the 27th. Perhaps there’s a huge backlog of parcels waiting to go out?
Wow, that surprises me. About 3 years ago I won easily for something that wasn’t as described- a Lush shower gel that smelled like mildew. I didn’t even have to send it back. I almost felt bad, how easy it was. Have they changed policy recently?
It’s impossible that the seller didn’t offer Paypal or an equivalent… You’re required to have a working account now in order to sell anything.
In 2009 Ebaystopped letting sellers list checks and money orders as official forms of payment for the vast majority of items. However, some sellers still list them (illegally), or will take a check or MO if you request - and Ebay states clearly that if such a transaction goes wrong, there is nothing they can do.
So yeah, you’re out of luck and $50. You made an illegal transaction in Ebay’s eyes and they are not liable for it.
I have won every case I have opened, 3 in my history of ebaying. In all of them I paid with Paypal and never received my item.
If you try to sell anything (except a few items in the categories laid out above), your Paypal account is automatically added to your listing. There is no way to deselect ‘Accept payment with Paypal’. So with that part of your story you are either confused, or lying.
It’s weird - the listing says the seller will only accept PayPal. You might be able to get the dispute re-opened or reviewed if you talk to an eBay customer advisor on the phone. (I realise that sounds like a waste of time, but I have heard success stories). eBay is usually biased in favour of the buyer - which is you - so you might yet prevail.
I notice you’ve already negged the seller, which might have the effect of sprinkling sand in the gears.
I note there’s another recent neg that looks like another buyer might have had the same problem (and the seller has responded that the buyer never bought anything, which is absurd nonsense, as it’s impossible to leave feedback without a transaction)
I was actually in contact with the other ‘buyer’ that left a negative-she had bought an antler and at that time he DID accept Paypal, she paid him and he reversed the payment to her, saying he no longer accepted PayPal and wanted her to send check or MO. She cancelled her bid because he changed the terms.
I have been talking to my credit union & the post office and so far getting nowhere. I will call eBay next…
You were scammed, but ebay can’t be responsible for people sending money outside of the systems they have in place to ensure that they can trace payments and refund your money themselves if something goes wrong. This has nothing to do with ebay, it was a private exchange of money between you and the seller.
This is true, as far as it goes, but the transaction/contract still happened on eBay - this isn’t one of those shady off-ebay sales that they just wash their hands of, and tell you it serves you right for trying to break the system.
Payment by means other than PayPal is still valid on eBay transactions. Sure, eBay can’t manage the process as they can with PayPal, but I don’t think it’s correct to write this totally off as none of eBay’s concern.
I called eBay and basically they said too bad, so sad. I think this sucks, and I told him they have lost a VERY good customer. They DID give me the seller’s phone number and I called; the seller (supposedly) wasn’t there but I talked to hiss so, who was very apologetic and promised me that he will get this taken care of. He took my address and what I had ordered.
I feel bad you lost your money. In the old, old days, I lost money on eBay, in the late 90s, it was a very risky thing.
The thing I hope everyone learns is NEVER, NEVER, NEVER under any circumstance, buy anything off the Internet unless it is a credit card or if you use PayPal and pay via a credit card ON PayPal. That way you can dispute PayPal and if that doesn’t work, you can dispute the credit card.
Somehow I missed this post. Why, may I ask, would you ASSUME I am lying?? I have nothing to gain by lying while asking for HELP and OPINIONS here. That was a very dickish post. I have told nothing but the facts here.
As I stated, he originally offered PayPal and removed it as an option. I felt like I was between a ropck and a hard place. All I wanted was a smooth transaction ad got screwed. Why are you accusing me of being a liar on top of it?
Pretty much, you only use Paypal on eBay*, unless you’re willing to kiss the money goodbye (I have sent cash on a couple of cheap items, where I just stuffed 2X $1 bills in a envelope, but I was willing to just kiss that $2 goodbye if nessesary).
You should have refused to pay, except by Paypal.
The eBay case resolution is very simple- ebay will check Paypal to see if you have paid. If so, then they will see if the seller has delivery confirmation. If the seller does not (and it’s past time for delivery), you win the case. I have won several such cases. Goods “significantly not as described” are harder, but I have won those also - generally, you just have to verify by Delivery Confirmation that you have returned the goods back to the seller. (The full amount you paid is refunded, but ebay does not make the seller refund your postage back)
Now, in this case, eBay can’t verify you paid, now can they?
If you have the email where the seller refused to accept Paypal, then you might have a case, but just to get the seller NARUed.
I would expect in this case there’s just a mix-up, they will send you the goods, then ask that you withdraw the NEG.
Really, this isn’t a case to get mad at ebay over.
Another warning sign is this part of the sellers TOS “**PLEASE REQUEST INSURANCE IF NEEDED THESE ANTLERS HAVE BEEN LOST IN THE MAIL MORE THEN ONCE. I WILL NOT REPLACE OR REFUND ANY ANTLERS THAT HAVE NOT BEEN INSURED!”. **This is false, and shows either he’s a scamster or doesn’t know how eBay and/or the Postal insurance system works. Once the seller gets the payment, he is 100% responsible for seeing the goods get to the buyer. I strongly suggest avoiding sellers who put crap like this in their TOS.
some very big sellers accept CC on their own, and that’s Ok, and there are a few other exceptions, as rhubarbarin pointed out.
And that’s another thing… I have no proof of it, but he added that little insurance disclaimer AFTER I had paid. It WAS NOT there when I bought the items.

WHY am I being treated like the bad guy here? I did nothing but try to buy some chewies my dogs wouldn’t burn thru in no time, and everywhere I turn I am being treated like I am the scammster. I am not lying about anything, not trying to pull a fast one.
This whole situation, including the way I am being treated here, bites.
No, you’re not a bad guy. But, you’re trying to make out eBay as the bad guy, where in fact, you violated eBay rules. It appears here that you also bought much of the product outside the actual auction, and eBay doesn’t like that, either.
In other words, you have a legit beef with the seller. You can file complaints with the postal authorities, FTC, District Attorney, or even sue him. However, you have no legit complaint with eBay.
