That’s fair. If the Trump administration can illegally declare a fake war against a nonexistent entity, then they can be charged with a crime they didn’t actually commit. Live by violating the constitution, die in a way that violates the constitution.

Not so. The first people convicted of treason under the U.S. Constitution participated in the Whiskey Rebellion of 1791; it was an uprising but not a war. Likewise Aaron Burr, prosecuted for his western schemes but acquitted in 1807. Certainly the modern practice has been to limit treason prosecutions to wartime or soon after, though.

The president had asked the members of a work crew putting up a new flagpole on the White House grounds to stand with him as he addressed the news media Wednesday. But then the questions shifted to immigration……
