Demonstrated that your claim that “under no circumstances would it be prosecuted as a crime” isn’t true, and that, as I said, harassment is a crime, which Diogenes wanted a cite for so he would have something to obliquely complain about.

I quoted it. There is nothing in your cite that is on point. Did you even bother to read it? You don’t understand the difference between criminal harassment and the civil tort of sexual harassment. You said Brett Favre was accused of a crime. The Deadspin article does not accuse Favre of anything in your cited statutes. You did NOT provide a cite that workplace sexual harassment (which Favre has still not been even been accused of, by the way) is a crime,a nd you have not provided a cite that anything Deadspin accuses Favre of is a crime. You can’t back up your assertions.

I’m not one to go around agreeing with **Dio **but he’s 100% correct. What you cited isn’t remotely applicable here. Sexual Harassment and Criminal Harassment aren’t comparable at all. You’ve not demonstrated anything in regards to my claim that sexual harassment is not a criminal offense, which as far as I can find in my fairly extensive Googling is absolutely true. And absent a complaint from Sterger or the massage therapists the civil violation isn’t applicable either.

The phone company, she could easily ask for them (they may even be on the website), again if she decided to cooperate.

I can’t imagine she would give the NFL that kind of access to her privacy, and even if she did, there still may not be any dick shots, and even if there were the NFL couldn’t prove it was his dick or that it was sent by him.

Sterger has nothing to gain by talking to the NFL, and not for nothing, but she still hasn’t even said that she felt harassed. If she actually slept him (it’s possible), she would have even less reason to want to cooperate.

The phone company would have a record of any MMS messages sent. They could confirm that a MMS message was sent on the day alleged that matched the file size of the accused dick shots from Favre’s number. It would be trivially easy to discover. Since the phones may have been on the Jets internal Blackberry or Exchange Server it might be even easier to uncover since the Jets IT staff would be able to uncover all that data without the phone company. Since these were allegedly Jets company phones neither person can claim any expectation of privacy.

Whether the dick shots are legit or not isn’t really meaningful until someone files a complaint.

I imagine that’s true, but I’d be surprised if they still had the actual bytes of the pics. They’re not bound by HIPAA or anything like that, so it’d be a massive waste of disk space. I guess it’s possible some arm of the gov’t may require them to keep MMSs around for a few years…

The bill based on volume of bandwidth consumed. They are going to keep that data for a long time on their own accord. It’s fundamental billing data.

There are two allegations against Favre; he’s admitted one of them. Can you admit it’s at least possible that the other allegation is true? Not likely, or even probable; just possible. Of course he denied the pictures: they are more flagrant and deniable. Can you also admit, even with just the voice mails, that it’s possible he intended to cheat on his wife and can you further admit, because he intended to cheat on his wife, his character is less than sterling?

I don’t give a shit about legal issues, breast cancer, or penis pictures. The guy admittedly, without his wife’s knowledge, asked another woman to come to his hotel room, ostensibly to ???. He’s reprehensible, unredeemable scum if for nothing more than that act. He’s pretty stupid too.

There are zero allegations against Favre. No one has filed either a civil or criminal complaint. Sterger has accused him of nothing.

He’s admtted to leaving some innocuous voice mails. The voice mails do not amount to an allegation of anything of any public interest or relavance.

There is no other allegation, and I have no interest in speculating about the private sex lives about NFL football players. None of my business.

I assume as a matter of course that all pro athletes cheat on their wives and that all their wives know it. I also don’t think anyone alive has sterling character, and most importantly, it’s none of my business. It’s not illegal to cheat on your wife.

I think that’s a ridiculously over the top characterization, so no. I can’t agree.
