2x the medical is not in play in California anymore. I’d thought it was an industry-wide thing, but maybe not. Here you’re lucky to get your note paid off completely, and doubly lucky if you have any money for your pain, trouble, and loss of a beloved car that they totaled-even with an attorney after they take their fees and the insured has maxed out their policy.

Not yet. SWMBO has, very reasonably, suggested that I keep myself leashed until we have settled with the insurance company. I will then make myself known to him, to the point where he will have the screaming heebie-jeebies if anyone mentions my name around him for the rest of his life.

But before I light him up, I’m going to use the “reasonable, rational” approach on him and suggest that we meet and talk. I will then, quite calmly, ask him to justify his nearly killing my daughter. I really want to hear his pathetic attempts to do so.

Clothahump, when I had my car totaled the insurance just wrote a check for what the rental car should have cost for however many days it took to resolve. If I had known that I would have just bought a new car immediately an I could have kept the money for the rental. Your daughter might be able to do the same thing if she has access to another car.

Um. what you seem to be talking about sounds illegal, clothahump, however justified it may be. Are you sure you want to go down that road? If you were to do something to this guy, they would throw the book at you. He did a very bad thing; you doing bad things won’t fix that, and it could get you imprisoned.

I assume you’re just blowing off steam here, but a lot of the things you’re hinting you might do are illegal or unethical and, if traced back to you, can get you in a lot of trouble.

Your daughter’s injuries are not a bargaining chip to get a better deal on the car settlement. If she’s injured, she should get a settlement for that, regardless of good a deal she got on the car.

I don’t think you can make this guy’s life miserable legally. As far as YOU are concerned, this was nothing more than a traffic accident, and whether he ran a red light, or did something else to cause the accident, all you can do is sue him for damages, which his insurance will most likely cover.

The authorities may make his life hell with the criminal charges he deserves, but you don’t make those decisions.

Get your Daughter to a doctor/Chiropracter ASAP.

in 2000 some retard pulled his car out of a parking lot directly into my lane and stopped. it was pretty minor as accidents go, about 25ish mph head on (or almost)

when the light turns green Turn your head and LOOK left and right BEFORE you enter. light changes are the most common point for colisions at intersections and are very dangerous due to the right angle type of crash.

I repeat have your daughter checked out, even if shes 100% aok you still need to confirm this.

I second what others have said about seeing a doctor.

My wife was lucky after her accident-a T-bone total by some old bag(with a cast on her foot), who ran through a WAY red light(way red as in my wife was the second car into the intersection)-because my mom was her chiro, and was able to continue treatment even after her medpay ran out. After 3 years, her whiplash injuries are finally healed enough that she doesn’t experience crushing headaches and neck pain on a daily basis.

Understood. It must be horribly frustrating for you as a parent to have somebody endanger your child and not be able to do anything about it.

If I was the guy our meeting would go like this.

“I’m sorry I hit your daughter and then didn’t stop, that was wrong and I completely apologize.”

“However, I had no intention of killing your daughter. I ran the red light accidentally, this was an accident, there was no malice on my part. You are a very unpleasant person, if you try to contact me again in any way, or act threateningly again, I will get an order of protection against you. Good day.”

What Martin Hyde said. She walked away without even needing to see a physician, that’s hardly “almost killed”. Walk through any busy emergency room and see the kids who really have been “almost killed” and then get down on your knees and thank your higher power that the only thing that happened to your daughter was that her car was wrecked.

If you had said that the day after the accident I would pass it off as shock, but as it’s been…what…three weeks? I think you need to get a grip and get some perspective.

I’d be pissed as hell if I was in his situation. But the thing is he didn’t try to “kill your daughter” unless you think he ran the red light with the intention of t-boning her. He was reckless, and after being reckless he was stupid (by running away from the scene.) I’ve seen nothing to indicate he was a killer though. I’d say he owes you an apology and you should probably milk him for money too. But the hyperbolic comment “tried to kill my daughter” just doesn’t sit right for me.

Hey, up yours, lorinada . He was driving an SUV, she was driving a Saturn. He hit her directly over the left rear tire. The only reason he didn’t T-bone her right over the driver’s door was that she saw him out of the corner of her eye and stomped the gas. If he had T-boned her on her door, he would have killed or hideously injured her.

That is “almost killed”. Let me draw you a parallel. You’re walking down the street and somebody shoots at you. The bullet hits the wall next to you, about an inch away from your ear. Are you going to tell me you weren’t “almost killed”?
