Well, there may have been been speakers of some Asian languages and there certainly were speakers of Spanish before the US moved in, but as far as I know languages spoken before the US moved in would not include all Asian languages, and would include French…Additionally, I doubt (although I don’t know if anyone has ever checked) that many places would meet the numerical threshold in Spanish and Asian languages if only the people of limited English proficiency whose ancestors were here before the US were counted. Those languages may very well be the most common languages spoken by naturalized citizens with limited English proficiency, but I don’t think the reason is “because they were here first” Otherwise, why is French not included while Vietnamese is?
Alaskan and American Indian languages are a somewhat different issue, since AFAIK, those languages are not spoken anywhere else, and therefore those of limited English proficiency must have ancestors who were “here first” ,and Native American nations (which may or may not include Alaskan natives, I’m not sure) have special status as sovereign nations, at least on the reservations.

The expiration date was probably a compromise to get it passed (IIRC, the civil rights act had one as well…). With republicans courting the hispanic vote, and democrats targeting all minorities, you can be guarenteed it being renewed.
