I’ve been showing it to people. It thoroughly amuses me that he felt that doing this would somehow help him win his case.
And, like my employee, why on earth would she think it’s a good idea to file for unemployment after sending a text like that. Not only do you have proof you offered her a job back, you also have proof that she declined that offer unless you were willing to break the law. This is one of those things that she should have called you about. She opened herself up to a lot of problems by putting it in writing (or texting). I’m assuming she’s not very likely to win the case.
Don’t forget, she almost certainly wants the money under the table so she can continue to receive UI benefits. Which, depending on what exactly is going on with PUA and the like, some of that UI money may be coming out of your account.
She was “permitted to withdraw the request” which I think is ridiculous. Instead of prosecuting fraud, they make things easier by permitting the party to say, “oops, my mistake”.
I used to work ( as an independent contractor) for an employer that was frequently in court over unemployment claims….he was difficult to work for and had an abusive streak, although he was an equal opportunity abuser. The employees fell into a couple of categories - people who were equally crazy and thrived on drama, people (like myself) who were normal skilled professionals who recognized that this place paid REALLY well if you could endure the craziness, and the hapless normie that typically lasted about two weeks.
But sometimes the drama between the crazy boss and crazy employee escalated to the point where the employee got fired for real - this was typically precluded by a month or so of escalating screaming fights, the employee walking out and quitting then agreeing to come back, a couple of fake firings that were rescinded or just forgotten - one acceptable response to being fired by crazy boss was just to keep showing up to work to see if anyone called you on it, and they usually didn’t. By the time the employee was really no longer employed, it was usually not clear at all as to whether the employee had quit or was fired, which is why they ended up in court all the time……I didn’t really quit I was fired four times before I actually left and even if I quit I was constructively fired because…….hostile workplace.
One former employee had her day in court and was unleashing her prepared litany of grievances in front of the judge. The boss was mean, he yelled at me, he makes me sit next to this guy that has BO, really judge, you should smell him, and can you believe the crap the served at some company party even though they KNEW she was a vegetarian…on and on.
Then the judge started asking questions like……how long ago did this happen? and he told her he wasn’t interested in hearing about the stuff that happened several months before she left.
The employee didn’t like being interrupted and told the judge that he wasn’t asking the right questions, he wasn’t good enough to be a real judge in a real court and he was just a hack that was only one step above a traffic court judge. Seriously. I’m not making this up.
And she was STILL surprised that she lost, although I believe she conceded that “she could’ve been more polite”.

Sorry, yeah, meant to address that. Immediately after the incident I downloaded the video from it happening. I don’t think I have that video at this point, but I did save a few stills, which I submitted as evidence against him. However, all camera footage gets deleted after a certain amount of time. That time is significantly less than when his employment was terminated over 6 months ago.
Forget showing us his statement, I would have loved to see the video of the pallets tumbling.

As am I. He should have been fired a few weeks into his employment here. Why he was allowed to stick around for so long is a debate for the ages. Though, to be clear, firing him, especially way back then, is a decision that would not have been mine to make. I suggested it on a regular basis, but he wasn’t someone I could unilaterally fire.
Some of it does. His first page was torn out of a spiral notebook, the rest appears to be loose leaf.
That first page also has his case number and some other info written in someone else’s handwriting. I’m WAGing that he went to the local UI office to complain about how this isn’t his fault, they told him to appeal it, someone wrote that at the top of the paper, ripped it out of a notebook and handed to him to write his appeal. It also appears it was faxed from some government office (header says ‘state of WI fax server’) to the UI office.
He probably scribbled down his excuse, handed that and his prepared speech back to someone and they sent it off. Presumably, whoever he was speaking to wasn’t allowed to give any advice or help with the appeal, just help navigate the system.
But that’s just a WAG, I honestly have no idea.
I had a woman who worked for me for 12 years. She was hired at minimum wage and persisted at minimum wage even when her coworkers got raises. I explained to her that she did the bare minimum necessary to keep the job, everyone else worked toward raises and got them. She told me she was fine with Minimum wage.
I liked her and still talk to her every so often.
And some people are fine with that. This guy actually told the UI board that he hadn’t received a raise in 10 years. Not only is it entirely unrelated to his claim, it’s entirely false and very easy to prove it’s false. While he might not keep his paystubs, I have, right here at my fingertips, access to every single one of his paychecks since he started working here. Surely he must know that, as a business, we keep payroll records and can look these things up.
I think part of the reason this guy persisted for so long is because, as much as he fucked up, he learned that all he has to do is take his lumps (ie, get reprimanded for 30 seconds) and whatever he did would blow over in a day or two.
The guys that I know who drive forklifts in Madison work for a beer distributor. In that case, they could’ve been pallets of glass bottles.
So, did The Forklift Incident involve breakables? Did products at least get damaged? I’m really enjoying the mental picture of Hillbilly Accuser sitting in a forklift surrounded by broken pieces of… stuff. Shaking his head, muttering “Not my fault, maaaan…”
I worked with a guy like that. Every single piece of paper he handled looked like it had been grabbed by a toddler.
