I’d personally think that if a customer threatened to sue me because of my actions, or inactions, I’d be inclined to look at what I was doing to see if there was any validity in their complaint. For everyone who threatens to sue there are probably a whole lot more who never come back once they see how you operate.
Even when a basic complaint has validity, some customers just aren’t worth keeping because nothing is ever going to satisfy them. Reading how stark, foaming insane Hildo was capable of going over such trivial things like board timeouts or old TV shows puts him pretty firmly in that category, IMO.
To be honest, I’d started hearing Bruce McCulloch’s voice from this Kids in The Hall skit every time his name appeared in a thread.
They did this when I was working there in 2002. You called up, got a little too irate with the CSR supervisor, and they’d cancel your account right then and there.
Certainly. Then you give them their fair portion of the money back that they have spent with you and each goes their merry way. I have the same caveat in the contract of the house I’m building. If I turn out to be a pain in the ass the company refunds my money and tells me to get lost. I assume this has been done in this case.
Yes, but the reason he is foaming is in reaction to someone else’s actions, or inactions, in regards to service he has paid for. That he is banned because he went to far in a complaint about that service (which may be minor nuisance to you and I) doesn’t mean he is wrong in criticizing it. If the powers that be used how far he took his criticism as the reason for banning him without compensating him for the time he didn’t use on this board (Maybe a $10 touch) then it is no worse, imho, than picking his pocket.
Even Nutty Bunny’s company wouldn’t think of taking a person’s money for a furnace and then because the guy is a trouble customer not returning it without delivering the service, or at least the furnace they purchased for him.
“We’ll need a $10,000 deposit please”
“Certainly, here’s my check. When do you think you can install it?”
“Sir we don’t like your attitude, so we can’t continue to do business”
“Huh!? Give me my check back!”
“Sorry, Sir, all money is non-refundable. Check your contract.”
I’m sure some companies do business that way. Hopefully, I never encounter any.
I deal with unhappy customers at times. There are some that will be reasonable and some that won’t. If I’m being nice and trying to find a solution and they keep going on and on, then at some point there is a time to pull the plug.
I’ve been involved in a lawsuit, and it’s not a pretty sight. If someone threatens to sue instead of working with me of finding a solution to the problem, then it’s game over for me.
The thing that I don’t get when people like poor little Johnny start foaming at the mouth about the slow response or board down time is the total lack of perspective. It’s a fucking message board! It exists purely for our entertainment and occasional enlightenment but none of our lives depend on it. The SDMB being unavailable is a very, very minor inconvenience.
You paid $15 to be entertained for a year and you’re going to threaten to sue because you couldn’t get connected a couple of times and the response wasn’t as lightening fast as you wanted? Sheesh, get a fucking life.
Step away from the computer and walk outside. There’s a whole world out there. With actual people in it.

I’m pretty sure the rules and regulations of the SMDB state that if you get banned, they keep your money. I recall reading something to that effect, but now I can’t find it in the rules. Anyone know where it is? Or did I eat too many Crazy Flakes this morning for breakfast?
Nevermind, I just found it.
I buy a ticket at the cinema. Once inside the theater, I pitch a fit because I think there are too many previews and I start urging all the other moviegoers to do whatever they can to hurt the theater management. Am I owed a refund after I’m tossed out?
If this isn’t a misrepresentation of Johnny’s situation, I don’t know what is, save something involving a lubricated stop sign and a fish.
I dunno. You tell me? Previews are part of the price nowdays. If the film kept breaking do you think the person should get their money back?
Of course you’re correct and I’ve been refunded at a movie theater for this exact same thing.
But you’re not going to win this argument, not here. Those arguing with you more than likely believe in the mantra, “it’s just business, not personal,” which is just an excuse to screw someone out of their money. This board seems to attract lots of those types. The philosphy is for the weak-minded, ill-mannered, and dishonest.
This ain’t my forum, but three points here from a Moderator’s point of view:
(1) Johnny is gone, and cannot respond. It is therefore inappropriate (even for the Pit) to make nasty remarks about him personally. That’s been a long-standing policy.
(2) Ask any lawyer. As soon as a customer threatens lawsuit, the first piece of legal advice is to is to break off any further communication except through the various lawyers. Any other response (or non-response) can be used as fuel against you in a lawsuit.
(3) Short periods of slow board activity are part and parcel of the deal. Any time there has been prolonged outage, subscriptions have been extended to cover the lost time.
Don’t misunderstand me. I understand this. I’m just looking at it and speculating from the other guy’s point of view.
Or, you can refund the unsatisfied customer, express sympathy (or empathy) by apologizing that you weren’t able to meet their needs, and close the business relationship. We’re talking about $15 here.
