My only (admittedly barbaric) consolation is that the man will either be in solitary confinement for the rest of his life or be beaten to death in prison. At least then he’d know some extremely small amount of the pain he’s putting the mother and child through.
The poor kid…I hope someone finds a cure for AIDS. I hope that kid lives. I hope that he gets cured. And I hope someday, maybe when the kid’s all grown up, he’ll find this man and give him a good, sound kick in the balls.

There is nothing I can say about this waste of life that hasn’t already been said, so I will echo the sentiments of those before me and hope this “guy” (a term I hesitate to use, as it implies that he might actually be human, and therefore the same species as the rest of us) gets what is coming to him.
I just hope and pray that the terrible situation of this family moves enough generous people, especially friends and neighbours around them, to give them a better quality of life. It sounds like they have been really struggling financially, which is appalling.
A lot of talk here lately about the death penalty. I’m currently against it because it’s unfairly applied. I feel quite sure that many executed persons have been “less guilty” (in an absolute sense) than this kid’s dad. A slow death, your life destroyed, your family’s lives destroyed, with nightmares about your own dad killing your family … surely this is worse than many quick deaths which have merited execution. I’m not exactly calling for the dad’s blood, but in a system which allows the death penalty, surely this guy deserves death.
It does appear that the approach taken in prosecuting him is designed to dish out as much punishment as possible. (Not knowing the ins-and-outs of the US justice system, I guess it’s possible that there was some other motivation for only charging him with first degree assault. Maybe case law made a conviction uncertain for attempted murder and they merely wanted to make sure he was sentenced for something?) At any rate, it seems like this way they can warehouse him, and if the boy dies before a cure is found, they can prosecute him for murder, and then push for the death penalty. While I abhor an institutionalized death penalty, there are cases where it doesn’t seem like such a bad idea. In this case, I’d volunteer to be the executioner. Especially if Montana uses lethal injection. With lye.
Now this is such a good argument for socialized healthcare in the states. The story is incredibly sad but I wouldn’t wish the death on his father. A really long life in prison without anything else to do ever. Solitary confinement without anything to do. If he killed himself that would be fine too. However, I would much rather him have to live out his life as a nothing for as long as possible.
I can’t believe this poor family is stuck in this financial situation - I live in Canada, and although I personally have not really used it, I think the socialized healthcare system is worth it, simply so that no one has to go through what this family is going through because a member of the family is sick. It could be improved, sure, but the idea behind the system is sound, IMHO.
One thing that totally surprised me was that the poor boy’s sister was acting out and aggressive, and she wants to play soccer but can’t for financial reasons. Surely any socer club would make allowances for this? There must be some kind-hearted soul out there who would be willing to help pay or even waive the fees to play? Why should she (and her sister) have to suffer so much for this, too?
I can’t belive this man could be as low and disgusting as to do that to someone, especially a child. Somehow it seems a bazillion times worse than if he had injected the mother, and even that is unfathomable! The kid was 11 months old!!! And he DELIBERATELY infected him with HIV/AIDS!!! Insane.

Death is too good for this evil man. I hope he becomes some huge motherfucker’s bitch in prison, gets passed around like a rag doll, gets AIDS, and has to suffer the same fate as the boy.
Yeah, I know, it’s a terrible thing to say. But like Earthworm, I just can’t help myself. Some people are just too damn evil.

As for why the charge was first degree asault instead of attempted murder- my guess is that the penalty is the same for both crimes, so the charge that was easier to prove was used.
But I have a question about this
Is there actually a law in those states that provides a lesser punishment for crimes involving a child victims than the same crimes against adult victims?
Well, not knowing his state’s law, I would guess that if he is charged and convicted of attempted murder, the state is precluded from charging him with murder when the kid dies.
My WAG is that they want to wait and hit him with a murder charge later on. I don’t usually wish violent crime on someone, but I wish only the worst for this waste of skin.

Hmmm…strange. This seems to vary state to state because if I’m correct, where I live(In Florida) he should be able to get Medicaid no matter how much the parents make because he is a child. That would last until he’s 21 though.
That said, I know how the family feels… Make too much to qualify for stuff like Medicaid, make too little to be able to take a hard fall should something go wrong.
