I have one question.
First degree assault???! Why couldn’t this be tried as attempted murder? There is no cure for AIDS/HIV, only treatment of the symptoms. This boy will eventually die unless a cure is found.
Come on! He knew EXACTLY what he was doing, and it was OBVIOUSLY malicious (with an intent to kill, albeit slowly) in nature.

It says in the article that they can try him for murder if/when the boy dies. Maybe that’s why they didn’t go for attempted the first time around, double jeopardy?
If he IS tried for murder though, can he get the death penalty for it?
I’m against the death penalty, but guys like this make it hard to stay that way.

Now that I spewed my bile, let me add that scientists are working on the AIDs vaccine furiously. It’s actually in testing mode right now. I’m waiting for it to be brought to a nearby city so I can volunteer to be a guinea pig.
Along with the vaccine, better and more potent (not to mention, cheaper) AIDs drugs are being developed along with it.
Hopefully, we’ll have a cure and/or excellent treatment as this child grows up.
Kids don’t vote, and they don’t have a powerful lobby. Neither, for that matter, do drug dealers or animal abusers. In many states (California, Texas, or Florida, for example) a crime that would put a sixteen year old to death for actions towards a 60 year old woman would put that same sixteen year old in juvie if done towards a 6 year old girl.
