MGM Resorts Sues Victims of Las Vegas Mass Shooting
“MGM Resorts International has reportedly filed federal lawsuits against hundreds of victims of last year’s mass shooting in Las Vegas in an apparent bid to pre-empt any compensation claims. MGM, which owns the Mandalay Bay hotel-casino and the venue of the Route 91 Harvest music festival, has argued that any lawsuits holding the company liable for deaths or injuries during the Oct. 1 massacre “must be dismissed” because the company took reasonable precautions to prevent such mass violence.”
MGM did nothing wrong. Nor did the concert promoters. Its 100% the fault of the shooter. The only reason the hotel is being sued is because of $$$$. What could anyone have done different? Room searches? Bag searches? One moron lawyer on local tv blamed MGM comping gamblers. WTF?
This is obviously a tragedy but how is suing other victims of the tragedy justice?
Sure, but it’s the lawyers who are doing all the work. I’ve been a member of 4 class action lawsuits over spam faxes. I’ve averaged around $150 each time in exchange for signing a form. The lawyer got way more, but he’s the one that arranged the group and filed.
I would feel better about MGM’s legal move if they admitted their own interest instead of spinning it as something being done for the benefit of prospective plaintiffs. “What happened to you is truly awful, but we don’t believe we bear any responsibility, and we’re confident that a court of law will agree with us. Any lawsuit against us would make us waste time and money presenting a defense, so on behalf of our shareholders we’re doing the best we can to avoid that outcome.”
We don’t yet know if MGM did anything wrong. Maybe they locked fire doors and people couldn’t get out. Maybe they had reason to know this guy was up to no good and ignored it. I agree, comping gamblers doesn’t seem like a valid basis to file a lawsuit.
I don’t know if MGM was negligent or not, but before a lawsuit if filed, the attorney represented the injured person has to have a good faith belief that they can establish a theory of negligence. They won’t just file a lawsuit saying “you owe us money because something bad happened at your hotel.” Then MGM can defend itself and the court system can figure it all out.
Except the MGM is trying to get a judge to say they have no liability without a trial taking place. Their argument is that the SAFETY Act absolves them of all liability because they hired a company with DHS certifications. I have a hard time believing a judge would rule in their favor with a blanket ruling at this point, but that is the argument they’re making.
I understand what their end goal is here; to not be deep pockets. But doesn’t this mean that the estates of the deceased/shooting victims need to hire lawyers even if they didn’t sue MGM? So now the crime victims need more out-of-pocket money to defend themselves???
That seems a misreading of what is happening. MGM isn’t suing anyone, they are asking for suits filed against them to be dismissed. I have no idea of the validity of that request - but all of the folks affected already have lawyers if they are suing.
Possibly the Daily Beast web-page has changed since you posted your quote.
Maybe the information on Daily Beast has changed since JohnT posted this morning, as Folacin suggested, but it is saying that MGM filed a complaint, not lawsuits. They are not the same thing. Look at the link.
