Someone upthread mentioned appeals won’t (might not?) delay sentencing. That is, he can appeal, but the sentence will already have started. IOW, if Merchan sentences him to jail, he’ll be doing his appeals from jail.

Disgrace, rigged trial, corrupt judge. So far the usual.

Hopefully, because it will take that long to make arrangements with the Secret Service for his prison stay. Not bloody likely, but a boy can dream, can’t he?

I’m sure that they did at some point in time in some locations. However, I also know that there have been several movements to make sentences uniform across judges and defendants, which may have removed this sort of right. After all, a judge can’t read a mind so how are they supposed to know if the defendant is remorseful? Should someone go to jail for longer because they have a natural poker face? Should someone else go to jail for a shorter period of time because they’re able to summon up some tears and play a scene for the judge?

You may, certainly, be right. I’d like to have something more authoritative if there is.

That’s normal, in my experience. The lawyers on both sides need to research and prepare their sentencing arguments. In a matter like this, it’s not like TV, where a sentence is rendered immediately.

After delivering its verdict, the jury is dismissed. The case then moves to the sentencing phase, a process largely controlled by Judge Juan Merchan.

The judge will likely set deadlines for the parties to submit sentencing memos — in which each side presents arguments in favor of its preferred punishment — and other court filings.

Trump will also likely sit for an interview with a probation officer for a pre-sentence report. The interview will likely include questions about Trump’s personal history and criminal record. The responses will be incorporated into a pre-sentence report for the judge, which includes sentencing recommendations for Merchan to consider.

Legal experts told CNBC they expect Merchan will set Trump’s sentencing date for within two or three months of the verdict.

Trump’s attorneys may try to push that date later — possibly even after the Nov. 5 presidential election. But Merchan is unlikely to grant such a delay without a good reason, New York City defense lawyer Michael Bachner said.

In the meantime, Trump will be free to speak to the press, travel and continue his presidential campaign. He will also no longer be bound by the gag order that barred him from discussing witnesses, jurors and the judge’s family members, among others.

I was a foreman for a guilty murder trial September 25 or so. He wasn’t sentenced for 4 months due to delays.

He was in prison, though.
