I would imagine a nfl kicker would (or at least should) generally know what the rules are, and he wouldn’t have done it if there was any doubt that it was not legal. I think it’s more likely he was capitalizing on a known quirk of the rules.
I understand the reason it’s there. It’s the least bad of a bunch of bad solutions. But, that’s a discussion for another day (and one that’s been beaten to death.)

Well, if it’s against the rules there should be a penalty. I don’t think the assumption that the lack of a specific named penalty for a given rule means it’s not punishable is reasonable. They could have called Unsportsmanlike Conduct, Delay of Game, Palpably Unfair Act and probably few other penalties based on not being a douche.
