This can’t be legal, can it? Not the banning of tail-gating in the parking lot, but the banning of it for 1 mile around the stadium. Are there any homes in that area? Doesn’t private property trump the NFL? Any Florida Dopers want to help me out here?

If public consumption of alcohol and open-air cooking are illegal, then yeah, that makes sense.

I always thought “tailgating” implied that you were at your truck (or car) and that you were NOT on your own property? It doesn’t sound like it would apply to people grilling in their own driveway. However, I’m sure that there are lots of private parking lots around the stadium, and it does sound like those lots are covered by this ban. Its common to regulate public behaviour on private property (loud music, nudity, etc) so this one doesn’t seem like much of a stretch to me. But then I didn’t just spend a few grand to go to the Super Bowl, if I did I might feel different.

So, why is this? To cut down on drunken rowdiness in the stands? Give the concessionaires more business? Homeland Security? What the …?

I’m not a huge football fan, but I heard that one of the reasons that the 49’rs are moving to Santa Clara is that the proposal to build a new stadium in requires a parking garage which negates the possibility of tailgating.

THIS IS BULLSHIT! Come on, this is the Silicon Valley. More complex problems have been solved on the back of a napkin at Togo’s. Design a perfect parking garage tailgating venue. Or just knock down the damn thing and have the Niners play at Stanford for a season. Get Larry Ellison to grab the loose change on the floor of his Ferrari to finance it. Make sure you run CalTrain and BART there while you’re at it.

Thank god I’m mistaken. I see that they’ve signed a lease at Candlestick Park (This is what it is called no matter what people say) for another 5 years. Christ, I don’t even like the 49rs, as their fans are the most obnoxious fair weather fans on the planet.

I thought the right to tailgate was in the Constitution somewhere. If not, it ought to be.

There outta be a law against having a rule against tailgate parties. They are often more enjoyable than the game itself.
