NY AG Letitia James drops the (civil) hammer {On Trump & Family} [9/21/2022]

This is the action that just a few days ago was being discussed (in NYT?) because Trump was seeking to dismiss based on a NY Appeals court ruling. Guess the trial judge wasn’t buying it.

Sanctions on counsel is a serious step; not the kind of thing one wants on one’s bar history.

One count down, six more to go. I didn’t realize this was going to be a non-jury trial. Was it always set to be that way, or did something change? Is it a bench trial with just the judge and lawyers?

I believe this was granted on a motion for summary judgment – the Defendant’s motion, no less! That basically means that the judge found there was so little evidence to defend against the causes of action brought by the Plaintiff that there was no need for a full trial. Evidence already presented is sufficient for a judgment.

IOW: Ouch!

ETA: I guess there were competing motions for summary judgment. Trump’s was denied in full, and Letitia James’s was granted in part and denied in part.

At a guess, because the remedy sought was the cancellation of corporate certificates. That sort of remedy under corporate law doesn’t sound like the kind of thing that goes to a jury. But what do i know about NY court procedure?

I’m sure someone will let me know if I’m wrong, but I believe these rulings may also be used as a basis for criminal charges if the New York AG decides to bring them.

As other posters have commented over the past year, running for President was the worst mistake of Trump’s life. He could have stayed a big shot rich New York grifter, but noooo! He voluntarily put himself under the presidential microscope.

Does the AG NY have criminal jurisdiction? I thought only the DA’s did, but whatta I know.

One of the articles said that the Manhattan DA has already passed on criminal charges on this issue.

Is lawyer, Alina Habba, failed to petition for a trial jury when she was supposed to. i.e. She failed to follow normal procredure and really hurt her client.

Would this pre-trial summary judgment phase still have happened if it were a jury trial?

All those episodes of Law & Order I watched didn’t cover this. If there were a jury, I would think they’d be given instructions that the Trump organization has already been found liable and they’re just there to decide what to do about it. But I could be totally off base here.

I guess Trump’s “worthless clauses” really were worthless…… as a defense.

Trump had argued that the fraudulent income disclosures were accompanied by disclaimers that were drafted in such a heavy-handed way that they made the financial disclosures worthless, and that the companies he did business with should have known that and done their own research.

I’m guessing the “everyone knows I lie so it doesn’t count” defense didn’t sit well with the judge, and he probably didn’t endear himself to the judge when he sued him.
