God damn it. Why does this shit always happen in Kentucky? This is why I flinch when I tell people where I’m from, and get irritated when people are surprised that I’m not a moron.

The dumbass part? Maybe. She said that the matter would be decided by a magistrate and would essentially come down to my word against his. In her opinion, if my goal was to get him to leave me the fuck alone, I would be better off letting her put the fear of God in him than duking it out in court. Save me some hassle as well. (And her too, I’m sure.)

Hate speech codes in public universities have routinely been struck, but as “vague” or “overbroad.” There is at least a hint in there that suggests that federal courts can conceive of a hate speech code that is sufficiently tailored to exclude only that hate speech which is deemed unprotected.

You’re right - hate speech is not covered by free speech in the rest of the world, but it is in the US. I thought I had seen some Supreme Court judgements upholding the idea that hate speech should not be covered under free speech, but I see that I am mis-remembering.

Not to worry, though; I’m sure you guys will tighten up your First Amendment some day like you’re tightening up your Free Market. :slight_smile:

As a longtime UK fan and former longtime Kentucky resident, I too share in your view.

Not only was this a racist and stupid thing to do, it demeans the school I like, and as you said, will invariably affect the college hoops team I hold most dear.

Bolding mine. No, not necessarily. Often times, it CAN be determined to be a threat. THAT is for law enforcement to decide. Like shouting “FIRE!” in a crowded theater, or leaving swastika signs all over a Jewish neighborhood. IF the intent is to threaten, then it indeed crosses the line.

It also depends on WHERE it was done-at the very least, it’s litering. You can burn a flag, or hang a politican in effigy on YOUR property, but if you do it on mine, I can definitely sic the cops on your ass.

Because it’s hard to hang a plagiarist when he’s already lynched himself.

It seems to me that by jumping to a conclusion that the reason the effigy of Obama was hung was based on his race alone is one of the reasons why race is still an issue in this country.

We’re at the point now where a news anchor will report that a white man and a black man are walking toward each other on the street, and the white man accidentally bumps into the black man…

I’m glad we’ve established that fact through… what exactly? Accustomed to and being concerned with are two different things.

In researching hate speech/free speech in the US, it appears that the only time hate speech is not covered by the First Amendment is when you are inciting imminent violence. Your examples do not breach the First Amendment in the US (they would be considered hate speech in Canada and the rest of the western world). An example of something that (probably) would cross the line in the US is inciting a mob to attack that particular black guy. Addressing a crowd and saying you should attack black people in general would be covered under free speech. At least, that’s how I understand it.
