As a participant in the hot and heavy action, does she have right to quash it or benefit financially from it?

I don’t know about the legal rights, but in practical terms, there’s nothing she can do. Any effort to fight it will make it more famous. She’d have a hard time claiming her reputation was damaged. She has worked hard for years to craft her image as a rich, vapid party girl, and the video doesn’t change that a bit. As for the money, well, psh. That’s pocket change for her.

If PH is considered a “public figure” there’s damn little she can do about the tape being out there. By virtue of being “public” she has already waived many of her rights to privacy.

When it comes to making money off the tape, however, she’s on slightly firmer ground. Paris Hilton the person has the right to make money off of Paris Hilton the “product” – i.e., her name and image have a certain market value (would you buy a poorly lit porn tape featuring Rick Salomon and an anonymous blond?), and she has a right to her share of the profits. IANAL, but if her ex-boyfriend or Red Light District Video can’t come up with some sort of release form or contract signed by Ms. H, she probably has a pretty good case for suing for compensation.

What I want to know is what she did to piss him off to the point that he’ll go to these lengths to destroy her (and I use the term loosely). I mean, whatever happened to “have a nice life?”
