Watch the video(s). Hell, you can hear the cuffs being put on off-screen, and then she’s walked back into frame, hands behind her back–cuffed.
Fuck if I know. I’m not a Texas lawyer or cop. That’s why I asked.
She moved to the shoulder to let the cop pass, I wasn’t sure if that’s considered a lane change, since the shoulder is not intended for traffic.
And DID violate DPS policy.
Damn it ! I hate to say this but that sound about right .
I would like to know why there was a plastic bag in her cell in the first place, I thought all objects that could easily used to commit suicide were removed from the person like belts shoes laces etc. So what with having plastic bags in a inmates cells ??
When you get stopped for a traffic violation the police write up a ticket or let you off with a warning . I see no reason for being locked up for 3 days .
She was to start a new job so why would she kill herself ???
Maybe. But Texas law arguably permits a lane change without signal upon the approach of an emergency vehicle with lights and/or siren.
Nevermind. I re-watched that part of the video, and saw she did switch from from one lane to another before he put on his lights. I had only watched that part once before, and in my head, I thought it was a one-lane road. It was a two-lane.
Encinia: Get off the phone!
Bland: (crosstalk)
Encinia: Get off the phone! Put your phone down!
Bland: I’m not on the phone. I have a right to record. This is my property. Sir?
Encinia: Put your phone down right now. Put your phone down!
(Bland slams phone down on her trunk.)
Huffpost transcript.
On her trunk, which is as I remember it. The trunk of the car that is in good view of the dash cam. Then…
Encinia: Come over here. Come over here now.
Bland: You feelin’ good about yourself?
Encinia: Stand right here. Stand right there.
He doesn’t want her there, she must be over where he is. Outside of camera range, IIRC.
There is a good reason, a concern for traffic safety and security, that she must not stand where she was? She needed to stand over here.
Now, for our next thread contest, which of you can come up with a plausible reason why this must be so. (Lets just leave aside, for the moment, why she had to put her phone down, no need to open up a whole 'nother can of case law worms.)
Contest will be judged on originality and creativity. Neatness doesn’t count, plausibility does, whether real or imagined.
It’s cooler under the shade!
How much “professionalism” do you expect from somebody with a GED and 4 weeks training?
I love these threads where the crux of the matter comes down to some fine intepretation of law X that dozens of smart people here, including actual lawyers and professionals, argue about for weeks, have the benefit of hindsite, and STILL can’t agree a to whether some fine line was crossed or not.
Yet we expect Joe Schmoe cop who probably spends most of his time dealing with criminals and assholes to do better on the fly.
Watch the damn video.
At around 11:48, you can hear him slapping the cuffs around his wrists.
At 12:26, he pulls her over to the car for some strange reason and then tells her to “stay right there, stay right there”. Then he radios to someone that he has her under control.
Then bizarrely he orders her to “stay right there” while he goes to her car. Instead of barking yet another stupid order at her, why not put her in the patrol car?
I saw the transcript. She is handcuffed, then this:
Encinia: Stop now! Stop it! If you would stop resisting.
Female officer: Stop resisting ma’am.
Bland: (cries) For a fucking traffic ticket, you are such a pussy. You are such a pussy.
Female officer: No, you are. You should not be fighting.
Encinia: Get on the ground!
So she was resisting and fighting. Note that there is a second - female officer. From what I have read on this, that was a black female officer. And she is definitely corroborating the “resisting and fighting” part.
I don’t know, because I wasn’t there. And neither were you. What is your law enforcement training, again?
So you haven’t watched the video?
It’s perfectly clear she was handcuffed rather quickly as soon as he had her step off-camera. This was before backup showed up.
Once cuffed, put her in the back of the cruiser. Why knock her to the ground? Really, why?
Did you not watch the videos either? We may as well have been there, for all it reveals.
… in the next part of the transcript:
Encinia: This officer saw everything.
Female officer: I saw everything.
Bland: And (muffled) No you didn’t. You didn’t see everything leading up to it …
Female officer: I’m not talking to you.
Bland: You don’t have to.
Encinia: 2547 county. Send me a first-available, for arrest.
Female officer: You okay? You should have Tess check your hand.
Encinia: Yeah, I’m good.
**Encinia: She started yanking away and then she kicked me, so I took her straight to the ground.
**
Female officer: And there you got it right there… I’ll search it for you if you want.
Female officer: Yeah.
Someone wanted the explanation of why Bland was on the ground? There it is. Witnessed by another police officer. A black female police officer. Guess you don’t trust her either.
I don’t trust any police officers involved with this case. Doesn’t matter what their race or gender is.
But not within department policy. Nor common sense.
So either you’re ostensibly a) incapable of forming your own opinion here, or b) avoiding an admission, one way or the other, for some reason.
It’s amazing how different the officer remembered what happened.

That isn’t what the video shows. Is it?
No I don’t especially when The code gives the cop broad discretion
I thought that was my point. He violated department protocol for professional behavior; can we at least expect that he follows his department directives?
What are you suggesting? Should we just accept that the cops are witless goons with guns and authority because that’s all we can afford, and everyone should suck up any unprofessional behavior, or we are responsible for anything that goes wrong?
