How much of an illegal drug (marijuana) would someone have to have in their home before police could get a warrant and arrest them for it?

The answer varies. Most of the time, I’d say that any amount, no matter how small, would be enough, as long as the police had probable cause to believe it was there.

Yes - they have to have probable cause, first of all, but any amount is illegal under federal law. If you’re in a state that allows medical marijuana, yes, you can have certain amounts if you have the card, but you will still be breaking federal law.

In short, any amount of unprescribed, regulated drug, be it a legal or illegal drug, is illegal.

There are no illegal drugs in my house, I was just curious if someone were to alert police to someone’s house where they knew they had it. Someone told me if its a small amount its barely illegal.
