Simple - deport illegals & use volunteer prisoners to work fields

I agree on one point, many have false documents and they and the people who make the documents for them are breaking the law. I do not blame the people for wanting a better life, but to me it is like a person who,steals some tihing , then is caught, put in jail, and is separated from their families. Their reason may be to better their families life but it doesn’t make it right.

There is little sympathy if a parent( who is a citizen) goes to jail for breaking a law and as a result is separated from her children, both the parent and the child suffer for the parent’s mistake. The illegals can always take their child back with them if they do not want to be separated from them, then apply to come back according to the laws of our country. If we want open borders that is one thing, but since we do not, then we should enforce the laws, or make a clause in them that in some dire cases there are exceptions. Which I believe is now on the books.

Which means they can’t come back at all if they are Mexican. There pretty much isn’t any legal way for a Mexican to immigrate. We want illegal immigrants, not legal ones. Which makes all this moralizing about the illegality of their behavior fall flat.

About 200,000 Mexicans emigrate legally to the USA every year (wiki). Note that you are right in that the Lottery and such have almost no spots open for Mexicans. (There are about 5000 TN-1 Visas issues per year, if you have a job offer here). That’s becuase the quota is just about completely filled with IR and F visas for Family of American residents or citizens. (And, from Mexico there’s a fairly long wait for Family of Residents, so the legal Migrant waits 5 years, becomes a Citizen, then brings him family in)

In other words, if you don’t have family here, yes, the chances are very small. Otherwise, there’s no limit as long as it’s “Immediate Relative.”

Clarifications. There are no spots, full stop, for Mexicans via the Diversity Lottery. There may not be a limit on the number on family-based applications that are approved every year, but there are only so many visas granted every year, limited by country of origin, the status of your family member (citizen vs. resident alien) and the immigrant’s relationship to the sponsor (eg - unmarried sons and daughters of a US citizen has a higher priority than the spouse of a resident alien). Unless you are the spouse of a citizen. And even then your initial visa is only good for two years, then you have to apply to get a permanent visa. And then apply later, if wish, to become a citizen.

As of July 2010, there are now visas available to unmarried Mexican sons and daughters of US citizens who’s applications were approved as of November 1st 1992. Yes, 1992. For Mexican spouses, children, and unmarried sons and daughters of Resident Aliens, visas are available for applicants approved as of June 1st, 2007. And, legally, you are not allowed to petition your relative and have them stay in the US while they wait to get a green card. An undocumented immigrant who is in the US for a year is barred from re-entry for three years. For more than a year, the immigrant is barred from re-entry for ten years.

It’s important to understand that it’s not a matter of first in line, first to get a green card. In practical terms, it is very very hard for the majority of Mexicans to immigrate legally. There is a strong disincentive to go through the process, and a very strong incentive for working and living here illegally. That is to say, the ability to make 10 times or more what you could make in Mexico, the tacit wink and a nod we give to illegal immigration, and the low risk of being deported. Why not come here illegally? You’d be a fool not to.

To me, it’s like all those really rich people taking strategic defaults on the mortgages of their second million dollar homes. Financially, it makes more sense to default, and the long-term risk to your wealth is limited. Sure, it’s probably fraud, and someone’s going to suffer for it, but hey, the defaulting home owner isn’t going to, so why should he care?

And besides, why is it (I’ve said this before) the immigrant’s responsibility to enforce our laws when everyone knows we won’t enforce them ourselves?
