I don’t understand the need for a jury trial for this. If it’s determined that it’s a lawful subpoena, and that he failed to appear, that should be enough.
I may not fully understand what you are asking but his trial has already happened, he was found guilty and has been sentenced. This has been the appeal and he lost. So I guess he can take it to a higher court now and delay serving his 4 months for a while longer.
He can ask. But the Supreme Court takes very few cases, and I believe turned down a similar request from Peter Navarro.
I really feel like we need some disincentive to filing these obviously hopeless appeals. Like, if you appeal, and lose, your sentence is automatically multiplied by 1.25, or something. Or your parole eligibility is changed so you have to serve more of the sentence before applying for parole. Nothing so onerous as to dissuade someone with a legitimate reason for appealing, but enough to make people like this decide to just take the loss and do their time. Maybe make the extension automatic, but the appeal judge has the authority to overrule that, if they think that the appeal had some merit, even if they lost.
I only now learned (because I get overwhelmed by the sheer volume of shithousery stemming from the Trump gang) that Bannon’s fraud trial has been delayed until September because it has been assigned to Judge Merchan, who is currently hearing the Trump falsifying records case.
It does seem as tho we are hearing more and more about appeals in recent years (as well as seemingly EVERYTHING being litigated in the first place.) It would be interesting to see if these are actual trends, or whether certain prominent appeals are just in the news more.
