This is in depth coverage of my previous post. I’d skip 5:45 to 8:37 which is audio banter between the judge and lawyer and doesn’t add anything to Michael Popoks commentary. He mentions the “incestuous” nature between the lawyers involved because they have all represented, or ARE representing someone involved in one of the multitude of crimes committed.

I recall someone saying, in a Trump thread, that being released from custody during appeals was rare. Is it really? Or does it depend on the length of the sentence?
I said that. And in my experience over 20 years, I can only recall one case where bail was granted on appeal where I worked. This was in California at the state level, and Bannon’s case is at the federal level, so it may be different.
I will add that in the one case where it was granted, it was a massive mistake on the part of the judge I worked for at the time, who was new to his position on the bench, and the consequences of his decision were horrible.
Among the bail considerations in federal court are whether the defendant has a prior criminal record, her/his ties to the community, and any other factors that bear on the risk of flight. But these are considerations for pretrial bail, so I’ve seen in the hearing transcripts I’ve proofread for federal court reporters. I’ve seen in sentencing hearings that convicted defendants are either handed over to the US Marshal Service right after the hearing (usually these folks are already incarcerated) or given a date at some fairly soon future time to report to prison. I don’t recall proofing any hearings where incarceration was explicitly stayed pending appeal.
Let me guess: it was a conviction for domestic violence, and the perp murdered his partner while out on bail.

Gah. Even worse. Only thing worse would be if the perp killed the child(ren) after molestation.
Please tell me that’s not what happened.
It didn’t, but it ruined the case for retrial and another child was molested in the interim.
That whole case was a clusterfuck.

I haven’t even said the half of it. Wish I could, but it would make the case too easy to identify.
He didn’t, but not because he learned from his mistake. It was because the entire criminal bar kicked him from every felony criminal case that was assigned to his courtroom from that day forward.
He was an excellent civil judge, though.
