Do you have reason to believe that the sentence handed down in this case fell outside of the jurisdiction’s allowed sentencing ranges? Or, like truthseeker, do you just feel like the judiciary is being unfairly harsh on bandit rapists?
I said nothing of the sort. I have no idea if the sentence is appropriate; I wasn’t at the trial and have no idea what factors were considered.
Question for you - do you believe that scenarios that we’ve given occur in real life, that those criminals must be given tougher sentences n that ranges in a law are there for that reason only?
To be fair, in cases like that there will be additional charges. Each of those mitigating factors is a crime in and of itself.

Or: “What would be a case when the minimum sentence would be appropriate? If the answer is ‘never’, that seems to violate the spirit of the law, which implies that some form of the crime described warrants the minimum”.
I think in general, it is best if the people who get to decide what sentence to assign are, you know, the judges that preside over the case. I rather imagine that they are considerably more knowledgeable regarding the interpretation of criminal sentencing guidelines than, say, some random guy on the internet who is on record as thinking that robbery rape is honestly not all that big a deal.
Judges can be more foolish than me sometimes. There’s a judge who gave a judgement that if a couple has sex that means they will be considered married. ofcourse, they are rare. Look it up, its recently only.
Rape is terrible n its a big deal. Don’t think that I think otherwise.

Bear in mind also, if we are to believe the stories we’ve been reading, that:
(a) Rape and other serious crimes against females have been an entrenched activity in India, and the culture has long been to tolerate that and look the other way;
(b) There have been a string of high-profile highly publicized and highly heinous rapes in recent months.

As India has modernized and become more cosmopolitan, there has been increased awareness and sensitivity among much of the public, about how obnoxious this all is, according to more evolved Western standards.
Thus, it’s not too surprising that the society is cracking down on sexually predatory crimes, and handing out harsh sentences to make sure the word gets out.
Much like we did in the United States when, after years of not taking drunk driving very seriously, we began to take it very seriously and treat it with relatively draconian sentences (compared to previously).

this is a very simple thing. nobody here is saying that women play some parts in their assaults.
there’s this recent caseof an american woman who went hitchhiking in india between 2 cities at 1 am in the night with 3 random guys on a truck and unfortunately got gang raped.
is it unacceptable to say she was being an idiot for doing that? i think its perfectly fine to say that.
