I thought they just got in trouble for terms regarding the order fulfillment. That is, dubious charges and difficult refund policies.
What specific claims do they make in the commercial anyway? “Natural male enhancement”? What does that mean? There’s no verifiable claims made.
They got in trouble for fraud and money laundering. There were also several individual and class-action civil suits filed, such as this one.
ETA: They also originally guaranteed visibly increased penis length or a double refund, but only gave back partial refunds or used tricky wording to dupe people into signing away their refunds.

It’s an herbal supplement so not under the guidelines of the FDA (cite) and they don’t really claim it to do anything specific. They sure suggest what it does for you but they don’t come right out and say it.
