As I read it, there were about a hundred people gathered in some sort of public meeting place in John Day. That is where the leaders were headed when they got waylaid by the constabulary.
Their purpose in going to John Day has not been given, but I think we’re can reasonably infer that they were hoping to woo over Grant county residents. Which is to say that they apparently meant to persuade additional co-conspirators to assist or join them in their ongoing action.
Now, I am not clear on how the law regards the act of encouraging others to engage in illegal action or to abet such action, but I suspect that would be some sort of offense. Like racketeering or somesuch. But, more importantly, the trip to John Day, which was interrupted by the capture, was in furtherance of the crime. Therefore, if the act of fortifying the Malheur Refuge against its designated proper use over a course of three and a half weeks can be considered felonious, the death of Bob Finicum occurred in the furtherance of that ongoing crime.
