Like you, I know naturopathic medical care is about as effective as just wishing the disease away. However, the evidence suggests these parents did not believe that, and there is rather convincing evidence that their belief was supported by official acts taken by the Crown (licensing naturopaths as doctors.)
I appreciate the importance of emphasizing the objective in matters pertaining to “necessaries” of life, but there’s also the issues, in criminal law, of reasonable doubt and mens rea. I would hope this case will cause people to all for people who are not doctors to not be called “Doctor” by the damn province.
Sure, but mens rea and reasonable doubt can be assessed on an objective standard, such as if a nurse says your kid may have meningitis, and he’s too stiff to sit in a car seat, you go to an ER. That seems to be what the jury decided.
