I wouldn’t be at all surprised if the GOP congress gives carte blanch emoluments permission before SCOTUS gets a far as a ruling.

My guess as to what happened:

Trump Aide: We need someone to head the main New York Housing and Urban development office.

I think you’ve found the fly in the ointment.

Constitution says “of any kind whatever”, so it would seem as though it should cover any kind of payment, of whatever form it takes.

The Emoluments clause is rarely invoked, because it is something that has been simply part of our culture since the constitution was formed. Emoluments were a big thing back then, where a wealthy nation would come in, and essentially buy or bribe the local government into acquiescing to their demands. Putting the heads of state in a situation where they were not allowed to accept such things was a novel idea, but one whose time had come.

So, here’s a question. That is just the second half of the clause, what about the first half. It says that the US cannot grant titles of nobility. Just as the second part of the clause has not gotten much exercise in the last couple of hundred years because the people in our government were not looking to abuse every single rule and law they could, what would happen if Trump started granting titles of nobility?

Is there any case law to deal with that? Is there anyone who would have standing to challenge it?

And why won’t Frederick Douglas return my phone calls? Hmmm, I wonder if he could set up a meeting with Harriet Tubman.

I’m betting he’s just forgotten whatever position he was advocating last time he expounded on this. I assume he’ll be back to kicking Dreamers around tomorrow.

It’s in the Constitution. Congress can’t change that on their own.

Here’s the exact wording (bolding mine):

“No Title of Nobility shall be granted by the United States: And no Person holding any Office of Profit or Trust under them, shall, without the Consent of the Congress, accept of any present, Emolument, Office, or Title, of any kind whatever, from any King, Prince, or foreign State.”

So a Congressional waiver would be necessary but sufficient.

But, in Trump’s case, the wild muskrat sits atop his head.

It’s still not clear to me whether that consent can be retroactive. Trump has already accepted emoluments and hasn’t even requested consent from Congress.

Katy Tur of NBC News is reporting that Trump’s lawyer, Michael Cohen, has lawyered up himself.
