The Trump Administration: A Clusterfuck in the Making

Can somebody explain to me how Neil Gorsuch is an originalist *and *a textualist?

The definitions I’ve seen said an originalist means that they go along with what the Founding Fathers said, but a textualist means that they interpret the law based on what’s there and not on what the originators said.

Isn’t this contradictory?

And, actually, I watched CNN tonight for the Supreme Court pick and it seemed to me the coverage was pretty fawning. I was wondering when they would finally mention the elephant in the room (the fact that this vacancy was stolen from President Obama with Merrick Garland not getting a hearing) and it took them until about 8:35pm (EST) before it was finally mentioned and then that was in a question to Cruz, who deftly deceived…and there was no followup by the reporter. (I don’t know if it was discussed further later as I didn’t watch for too much longer after that).

I think the questions about the LGBT position were someone who knew more than @RoguePotusStaff setting them up to show that they weren’t remotely in the loop.

Any fool who claims to go “along with what the Founding Fathers said” knows very little history. All of them agreed on breaking with Great Britain–although they didn’t all come to that decision simultaneously. After that, they disagreed on many issues…

I think the way those two fun flavors usually combine is for the judge to read the plain meaning of the text but where there is ambiguity in the meaning of the text, they try to divine the writer’s intent.

There was actually a serious question hidden behind my comment. If I had been with Dean when he said that, I would want him to clarify if by “calamity” he was predicting that the Trump Administration will go down in flames (maybe a good thing in my book) or the world will go down in flames (maybe not so good).

It usually depends on which result the judge wants.
