Treason CAN be a capital offense, but it doesn’t have to be. A prosecutor is not obligated to seek the death penalty during sentencing, just like they are not obligated to seek the death penalty for murder. There are lots of people in jail for murder–a capital crime–and they do not face execution.
Here’s the pathetic logic of the OP:

I never should have tossed that comment out. The point has been lost in the metaphor. I don’t know anyone who would truly qualify as a fan of Ann Coulter. What should we do about her name-calling? Bring charges? Class action libel suit from all liberals? Spanking is about as reasonable.
My mother always used to say that it takes all kinds to make a world. I guess Ann Coulter fills some political niche. The marketplace would indicate that. The best thing to do with politically pugilistic pundits is to let them have at each other. That’s freedom. Coulter is a great talk show guest. I’ve never seen one interview with her go smoothly.

My statement is quite easily proveable. He attacked the sovereignty of of another nation without any of the justifications enumerated by the UN Charter and he has refused to honor the Geneva Convention as it pertains to POWs in Guantanamo Bay. He is a war criminal, QED, even though he will never be prosecuted for it.
