These two phenomena–Pirro making a stupidity-laden remark, and Pirro being sued–are, of course, related. Plainly her defense to the lawsuit will be, as for other Fox News hosts in the past: I couldn’t have done your company any damage because no one pays any attention to anything I say (due to my spectacular idiocy).

And the thing is: it could work. She could escape responsibility. She just has to keep proving, night after night, that she’s a moron and well-known to be a moron.

The defense always seems to come down to

“Fox News is not actually a news organization; Rather, it is a bunch of idiots spewing garbage for purely entertainment purposes, and everyone knows this.”

That’s right. And everyone knows you shouldn’t be automatically charged for entertainment channels by your cable provider*. You should be able to opt in to paying for Fox “News” the way you opt in to paying for Starz or Epix or The White-Supremacy Channel.

*for those millions of Americans who do still have cable.

Perhaps part of the settlement could involve the Chryon scrolling She’s a moron - pay no attention over and over while she’s on.

Even after all I’ve seen on FOX, the level of racism and hate mongering is reaching a breathtaking level. (For anyone that didn’t click on that link, it’s inaccurately claiming that whites are at the back of the queue and undeserving Haitians are getting all the therapeutics).

He may as well just call them n*ggers at this point (after all, that’s another “cancel culture” thing).
There is no pretending about what the show is any more, no “dog whistles”.

Heh, in more than one occasion I pointed to the right-wingers in the SDMB to real Critical Race Theory research that investigated China’s treatment of the Uighurs and the research papers were very critical about the injustice. (CRT is not just about race, you dolts).

What I noticed is that the right-wingers still go on believing the caricature of CRT that they get from FOX News and others and willfully ignore that they shoot themselves in their feet by following the narrative that makes them foolishly ignore evidence (and ban the teaching of research that would help them!) just because idiot propagandists have more power now to convince a lot of Americans about what is “reality”.

My wife was in the hospital this week. I was there every day and passed by waiting room\lobby that had fox on with the volume up. I passed it about 2 dozen times. There was never any news. It was constantly horrifically biased and a lot of flat out lies about democrats and commentary masquerading as news.

These people have no shame or morals or ethics.

But they have buckets of cash. And that’s what counts in life for them apparently.

I know a guy who once said that wealthy people in general must be morally good. When asked why he thought that he immediately replied “because they have all that money.”

This is problematic. If they can claim that their purpose is to provide entertainment rather than information (as evidenced by their abundance of opinion programs), they might be able to evade journalistic standards of accuracy. This would not affect their broadcasting content, and their viewers would not perceive the content differently, but if it is “entertainment”, its inaccuracy/deceitfulness would not be subject to debate.

In the end, The Onion is actually regarded by many as a useful source of information, in the sense that it points out the absurdity of the country and gives readers food for thought. FuckedNews could realistically claim they occupy the same niche, and that their content is protected by 1A.

The ultimate question is whether the courts will address that mission statement or whether the question turns on the effects of their broadcasts. Because, even satirists are not immune to charges of libel. It all depends on how sacred lying it seen to be, as generally demanding accuracy in public statements could have a brutal impact on our consumer economy.

This is a brilliant idea that Fox would be foolish to ignore. I mean, I NEVER watch Fox News. (My thanks, as always, to all here and elsewhere who do the painful work of watching that benighted channel and reporting on what’s there.)

But if there were the prospect of seeing so truthful a chyron under Pirro’s show, I’d find myself tuning it in–and so would thousands (at least) of others who normally would never watch.
